EXECUTIVE SUMMARY
Staff is recommending that City Council designate Adam Politzer, Interim City Manager, Abigail Thorne-Lyman, Base Reuse and Economic Development Director, Allen Tai, Planning, Building and Transportation Director, Walker Toma, Base Reuse Manager, Cara Silver, Special Counsel, and Daniel Turner, Deputy City Attorney as the real property negotiators for the parcel designated as APN 72-382-9, an enclaved parcel located within the area known as Encinal Terminals in Alameda, which will allow them to meet with City Council in closed session to discuss price and terms related to a potential amendment of the existing lease of the premises in a manner compliant with all applicable laws and to represent the City of Alameda (City) in negotiations with a public or private party.
BACKGROUND
Encinal Terminals consists of multiple contiguous parcels bounded generally by the Oakland-Alameda Estuary to the North, Fortmann Basin to the East, Clement Avenue to the South, and Encinal Basin to the West. Within this area, the City owns the parcel designated as APN 72-382-9 (Parcel), and the remaining parcels are under private ownership.
Bayview Landing L.P. (Bayview) holds a ground lease for the Parcel (Lease), which will expire in April 2029. The Lease limits the use of the property to maritime and industrial uses, and Bayview desires to explore other uses of the Parcel. Such a change would require an amendment of the Lease.
DISCUSSION
Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Parcel. Staff is recommending that City Council approve Adam Politzer, Interim City Manager, Abigail Thorne-Lyman, Base Reuse and Economic Development Director, Allen Tai, Planning, Building and Transportation Director, Walker Toma, Base Reuse Manager, Cara Silver, Special Counsel, and Daniel Turner, Deputy City Attorney as the real property negotiators for a potential amendment to the Lease of the Parcel, located in the Encinal Terminals area bounded by the Oakland-Alameda Estuary, Fortmann Basin, Clement Avenue, and Encinal Basin in Alameda, which will allow them to meet with City Council in closed session to discuss price and terms for this property in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

FINANCIAL IMPACT
There is no financial impact from the approval of real property negotiators.

ENVIRONMENTAL REVIEW
This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.
