AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING SECTION 8-8.10 (NO PARKING IN BICYCLE LANES) TO ARTICLE 8-8 (GENERAL PARKING REGULATIONS) OF CHAPTER VIII (TRAFFIC, MOTOR VEHICLES AND ALTERNATIVE TRANSPORTATION MODES), TO PROHIBIT THE PARKING OF A VEHICLE IN ANY DESIGNATED CLASS II, CLASS III, OR CLASS IV BICYCLE LANE WITHIN THE CITY OF ALAMEDA
WHEREAS, the City of Alameda has an extensive network of bicycle lanes and bikeways throughout the City to promote safe and efficient travel for people riding bicycles; and
WHEREAS, California Vehicle Code Section 21211 prohibits parking in a Class I bikeway (multi-use path), but does not clearly extend that prohibition to Class II (bike lanes), Class III (bike routes and bike boulevards), or Class IV (separated bike lanes) bikeways; and
WHEREAS, the absence of clear state law prohibition on parking in Class II, III, and IV bikeways requires the City to rely on alternative citation bases - such as parking prohibited all times, no double parking, or out-of-marked-space violations - to address vehicles parked in bicycle lanes, workarounds that are not uniformly applicable across the City's bicycle network; and
WHEREAS, vehicles that are parked in Class II, III, and IV bicycle lanes create hazardous conditions for motor vehicle drivers, bicycle riders, and pedestrians by forcing bicycle riders into motor vehicle travel lanes or onto sidewalks; and
WHEREAS, adopting a local ordinance to prohibit parking in all classes of bicycle lanes will provide clear, consistent enforcement authority; improve motor vehicle, bicycle, and pedestrian safety; and align the City's enforcement program with those of comparable public agencies
NOW, THEREFORE, the City Council of the City of Alameda does hereby ordain as follows:
Section 1. LOCAL AMENDMENTS TO ALAMEDA MUNICIPAL CODE
Article 8-8 (GENERAL PARKING REGULATIONS) of Chapter VIII (TRAFFIC, MOTOR VEHICLES AND ALTERNATIVE TRANSPORTATION MODES) of the Alameda Municipal Code, is hereby amended to add:
8-8.10 - NO PARKING IN BICYCLE LANES.
It shall be unlawful for any person to park a vehicle in any portion of a designated Class II (bike lane), Class III (bike route or bike boulevard), or Class IV (separated bike lane) bikeway (as that term is defined in California Streets and Highways Code Section 890.4, as that section now exists or may be amended from time to time) within the City of Alameda, unless lawfully parked as otherwise permitted by law or official traffic control devices.
Section 2. PARKING PENALTY
The Parking Penalty Schedule for the City of Alameda is hereby amended to establish an initial penalty for violation of Alameda Municipal Code Section 8-8.10 of $79.00. Modifications to this amount may be made by City Council resolution.
Section 3. CEQA DETERMINATION
In accordance with the California Environmental Quality Act (CEQA), the City Council finds and determines that the adoption of this ordinance is categorically exempt from further environmental review pursuant to CEQA Guidelines section 15301 (Existing Facilities).
Section 4. SEVERABILITY
If any provision of this Ordinance is held by a court of competent jurisdiction to be invalid, this invalidity shall not affect other provisions of this Ordinance that can be given effect without the invalid provision and therefore the provisions of this Ordinance are severable. The City Council declares that it would have enacted each section, subsection, paragraph, subparagraph and sentence notwithstanding the invalidity of any other section, subsection, paragraph, subparagraph or sentence.
Section 5. IMPLIED REPEAL
Any provision of the Alameda Municipal Code inconsistent with this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to the extent necessary to effectuate this Ordinance.
Section 6. EFFECTIVE DATE
This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
