EXECUTIVE SUMMARY
Bay 37, Phase 1, consists of Tract 8524, which subdivided 7.47 acres of land located at the intersection of Mitchell Avenue and Fifth Street creating nineteen (19) parcels for residential units and seventeen (17) parcels for private streets and open space.
Bay 37, Phase 2, consists of Tract 8591, which subdivided 6.01 acres of land located on Mitchell Avenue creating fourteen (14) parcels for residential units and eleven (11) parcels for private streets and open space.
Bay 37, Phase 3, consists of Tract 8617, which subdivided 3.74 acres of land located near Mitchell Avenue creating fourteen (14) parcels for residential units and eight (8) parcels for private streets and open space.
Pulte Home Company, LLC has completed the public improvements within Tracts 8524, 8591 and 8617, and staff is recommending that the City Council accept the improvements as completed.
BACKGROUND
On October 14, 2019, the Planning Board approved the Development Plan, Density Bonus, and Tentative Map applications by Pulte Homes for 357 residential units in the development. On November 19, 2019, pursuant to Resolution No. 15609, City Council approved with conditions, Tentative Tract Map 8524, Phases 1 - 3.
On October 6, 2020, pursuant to Resolution No. 15699, City Council approved Final Map 8524 and Subdivision Improvement Agreement for Bay 37, Phase 1.
On July 6, 2021, pursuant to Resolution No. 15793, City Council approved Final Map 8591 and Subdivision Improvement Agreement for Bay 37, Phase 2.
On April 19, 2022, pursuant to Resolution No. 15889, City Council approved Final Map 8617 and Subdivision Improvement Agreement for Bay 37, Phase 3.
DISCUSSION
The public improvements for Bay 37, Phases 1-3, Tracts 8524, 8591, & 8617, consist of the sanitary sewer system. Other improvements, such as the private streets, open spaces, sidewalks, streetlights, landscaping, irrigation, stormwater drainage system, and private stormwater treatment system shall be maintained by the Homeowners Association.
Staff recommends the acceptance of the completed public improvements outlined in Table 1 below:

Pulte Home Company, LLC, provided a surety for the public improvements for Tracts 8524, 8591, & 8617 with a Performance Bond and Labor and Materials Bond each in the amounts listed in Table 2 below:

Following the acceptance of the completed improvements listed in Table 1, the Performance Bond and Labor and Materials Bond will be released and Pulte Home Company, LLC, has provided a warranty bond in the amount of 10% of the work completed per the Subdivision Improvement Agreements.
ALTERNATIVES
• Accept the improvements completed by Pulte Home Company, LLC, for Bay 37 Phases 1, 2, and 3.
• Accept the improvements completed by Pulte Home Company, LLC, for Bay 37 a Phase or Phases deemed appropriate by City Council and remand the project back to staff for further consideration and evaluation of the remaining Phase(s).
• Remand all Phases back to staff for further consideration and evaluation of the completed improvements.
FINANCIAL IMPACT
The City of Alameda (City) will own, operate and maintain the public sanitary sewer system. Funding for ongoing maintenance and capital renewal is available in the Sewer Fund and Alameda Landing Municipal Services District (MSD), which is an assessment district on the Alameda Landing project that provides funds for public infrastructure at Alameda Landing.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
Tracts 8524, 8591, & 8617, - Bay 37, Phases 1, 2, & 3 - are consistent with the General Plan, the Zoning Ordinance, the Alameda Landing Master Plan, and Alameda Landing Waterfront Development Plan.
ENVIRONMENTAL REVIEW
On December 5, 2006, City Council certified the Final Environmental Impact Report for the Alameda Landing Mixed-Use Development Project (a Supplement to the 2000 Catellus Mixed-Use Development Project EIR) in accordance with CEQA (State Clearinghouse #2006012091). The City has also prepared several addenda to the 2006 SEIR.
Additionally, on July 18, 2017, City Council approved an Environmental Assessment of the Bayport/Alameda Landing Master Plan Amendment. The Environmental Assessment concluded that the Master Plan Amendment (provided that the traffic trip cap established by the Master Plan is maintained) would not generate any new, or substantially more severe, impacts than might be expected as compared to those identified in the 2006 SEIR.
The proposed action, as part of the Alameda Landing project, was addressed by the analysis set forth in the 2006 SEIR and 2017 Environment Assessment, and pursuant to CEQA Guidelines sections 15162 and 15163 none of the circumstances requiring further CEQA review are present.
CLIMATE IMPACT
There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
RECOMMENDATION
Adopt a resolution to accept the Public Improvements completed by Pulte Home Company, LLC., for Tracts 8524, 8591, and 8617.
