BACKGROUND
 
In January 2012, Public Works staff issued a Request for Proposals for the preparation of engineering documents for the abandonment and relocation of existing sanitary sewer main and lagoon seawall, No. P.W. 01-12-03.  On March 20, 2012, the City Council awarded a contract in the amount of $112,400, including contingencies, to Water Works Engineers for the project.  On June 18, 2013, the City Council awarded a first amendment to the agreement in the amount of $57,000, including contingencies.  The amendment was to prepare the supplemental design drawings specifying the extent and type of construction being performed, including the amount and type of landscaping and hardscape to be removed; the underground improvements; and the materials to be used for surface restoration.  On July 1, 2014, Water Works signed a Second Amendment to Agreement to extend the term of the agreement for another year to add design of the following sewer relocation projects that had not been originally contemplated:
 
·      South Shore Lagoon Seawall:  The sewer main runs along a portion of the face of the former seawall (the north side of the lagoon) between Paru Street and Bay Street.  The age of the pipe and its current location increases the potential for sanitary sewer overflows into the Bay and needs to be relocated.
 
·      Private Property (Extension of Clinton Avenue):  The sewer main runs through private property and, in some instances, is beneath existing homes.  The main appears to have been constructed in anticipation of Clinton Avenue being extended westerly from its current terminus at Sherman Street.  However, the street was never constructed and private residences were built.  Due to its location, the pipe is difficult to access and maintain, and needs to be relocated.
 
 
 
DISCUSSION
 
In addition to the First Amendment to the Agreement, a change order was authorized to use the agreement's contingency funds and funds designated for the engineering services during construction phase to provide additional public outreach coordination for the three residential pump stations on Sherman Street and to execute the necessary custom electrical design work for the Paru Street pump station.  A Second Amendment to the Agreement was added to extend the term for another year to complete the additional documents as described above.  
 
Due to these design changes, a Third Amendment to the Agreement is now needed in the amount of $79,994, including contingency, for final design revisions and engineering services during construction and to extend the term for another year.  This project is expected to be constructed in the fall of 2015.
 
FINANCIAL IMPACT
 
The funds for this project are budgeted in the Public Works Department's account for Capital Improvement Program (90909) for the abandonment and relocation of existing sanitary sewer main along a portion of the lagoon seawall and sewer line along Clinton Avenue, with monies from the Sewer Enterprise Fund (Fund 602).  There is no impact to the General Fund.

ENVIRONMENTAL REVIEW
 
In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under CEQA Guidelines Section 15301 - Existing Facilities.
 
RECOMMENDATION
 
Award a Third Amendment to the Agreement in the amount of $79,975, including contingencies, to Water Works Engineers for the preparation of engineering documents and engineering services during construction for the abandonment and relocation of existing sanitary sewer main and lagoon seawall, No. P.W. 01-12-03.
