EXECUTIVE SUMMARY
Alameda Municipal Code (AMC) Section 30-95.1 requires the Planning Board to conduct a public hearing at which the applicant must demonstrate good faith compliance with the terms and conditions of the West Midway and RESHAP Project Development Agreement (DA). BC West Midway, LLC, has submitted a letter, included as Exhibit 1, demonstrating their good faith compliance with the terms and conditions of the DA for the period January 1 to December 31, 2025.
Staff is recommending that the Planning Board find that the developer has complied in good faith with the terms and conditions of the DA, as presented in the letter dated March 18, 2026 from the developer in Exhibit 2.
BACKGROUND
The City of Alameda and BC West Midway, LLC entered into that certain Development Agreement for the West Midway / RESHAP Project dated as of October 5, 2023.
The project developer is making progress on planning activity, construction activity, affordable housing preparation, mitigation monitoring, formation of a community facilities district, and coordination with the Site A project.
DISCUSSION
The developer will continue to implement the DA and is proceeding through stages of preparation to facilitate vertical construction in a phased manner consistent with the master plan and design review.
ENVIRONMENTAL REVIEW
The action requested is an informational item. Development Agreement annual review is not a project as defined in the CEQA Guidelines Section 15378, therefore, no further action is required.
RECOMMENDATION
Approve the draft resolution (Exhibit 2) finding that the Developer has demonstrated good faith compliance with the terms and conditions of the Development Agreement.
