Recommendation to Authorize the Interim City Manager to Execute a Fourth Amendment to the Agreement with Kittelson & Associates to Extend the Term of the Agreement to Provide Technical Services Related to the Clement Avenue/Tilden Way Project for Two Years.

EXECUTIVE SUMMARY

 

The Clement Avenue/Tilden Way Project broke ground in December 2025 and the project is currently under construction. Kittelson & Associates (Kittelson) is the engineering services design consultant for the project and is integral to providing technical services throughout the construction process. The Agreement with Kittelson expired on January 1, 2026. Staff is requesting approval to extend the term of the Agreement by two years, expiring on January 1, 2028. No additional compensation is requested under this Amendment.

 

BACKGROUND

 

On November 10, 2020, the City of Alameda (City) entered into an Agreement with Kittelson to help the City analyze and review location of roundabouts to help improve safety for all roadway users, for an amount not to exceed $37,850 and with a termination date on June 30, 2025.

 

On June 29, 2021, the First Amendment of the Agreement was executed to provide additional services for implementing roundabouts in Alameda, including community engagement, design analysis, and grant writing, for an amount not to exceed $37,120 and total aggregate compensation not to exceed $74,970 and no changes to termination date.

 

On December 21, 2021, City Council authorized the City Manager to execute the Second Amendment of the Agreement to provide additional services related to roundabouts and complete the planning/scoping phase of the Clement/Tilden Project, for an amount not to exceed $270,906 and total aggregate compensation not to exceed $345,876 and no changes to the termination date.

 

On March 21, 2023, City Council authorized the City Manager to execute the Third Amendment of the Agreement to provide engineering design and construction support services for the Clement/Tilden Project, for an amount not to exceed $1,130,000 and total aggregate compensation not to exceed $1,475,876 and extending the term of the Agreement to expire on January 1, 2026.

 

DISCUSSION

 

The Project is currently under construction with an estimated completion date of December 2026, pending weather conditions and unforeseen changes in the project that may extend the completion date into 2027.

 

Staff recommends extending Kittelson’s Agreement with the City by two years until January 1, 2028. The extension will allow Kittelson to provide technical services for the duration of construction and close out, all of which includes reviewing material submittals, assisting with request for information generated by the contractor, assistance with analyzing construction claims, and recording changes to the construction plans during the closeout phase of the project in accordance with the scope of services outlined in the Agreement. The proposed Fourth Amendment to the Agreement does not change or increase the Agreement total budget, which is a not-to-exceed amount of $1,474,876.

 

ALTERNATIVES

 

                     Authorize the Interim City Manager to execute the Fourth Amendment to Kittelson’s Agreement.

                     Authorize the Interim City Manager to execute the Fourth Amendment to Kittelson’s Agreement with revisions determined necessary by the City Council.

                     Do not authorize the Amendment and reallocate Kittelson’s services/tasks to City staff or other Project consultants, which will require amending other consultant agreements.

 

FINANCIAL IMPACT

 

There is no financial impact to the Project. No additional compensation is proposed under this Amendment.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

The recommended improvements to Clement Avenue and Tilden Way are consistent with Alameda General Plan mobility goals, including Equity, Safety, Choices, and Sustainability

 

The improvements are included in the City of Alameda 2023 Strategic Plan as Project # TIE14b (investment in transportation, infrastructure, economic opportunities, and historic resources), and are consistent with the Active Transportation Plan, which includes a separated bikeway along Clement Avenue and Tilden Way, and the 2030 Infrastructure Plan that include Project #3: Clement Avenue: Cross Alameda Trail Gap Closures.

 

This action is subject to the Levine Act.

 

ENVIRONMENTAL REVIEW

 

In accordance with CEQA, this action is categorically exempt from further environmental review pursuant to CEQA Guidelines Section 15301 (Existing Facilities) and Section 15304 (Minor Alterations to Land).

 

CLIMATE IMPACT

 

Since vehicle miles traveled is the largest source of greenhouse gas emission in Alameda, safety improvements in support of pedestrians, bicyclists, and transit will have a positive climate impact.

 

RECOMMENDATION

 

Authorize the Interim City Manager to execute a Fourth Amendment to the Agreement with Kittelson & Associates to extend the term of the Agreement to provide technical services related to the Clement Avenue/Tilden Way Project for two years
