EXECUTIVE SUMMARY
Staff recommends that the City Council approve a 59-month lease with All Good Living Foundation (AGLF) for approximately 10,050 square feet of City-owned land at 1900 Thau Way adjacent to Jean Sweeney Open Space Park. The property includes a portable building located on the property previously used by and currently owned by the Alameda Food Bank. The Alameda Food Bank has offered to donate the portable to AGLF, if AGLF is able to enter into a lease with the City of Alameda (City) for use of the land. All Good Living Foundation is a local non-profit with a mission to help the Bay Area’s most vulnerable children so no child goes without the necessities to lead a healthy and happy life.
BACKGROUND
The 10,050 square feet of City-owned land located at 1900 Thau Way has been leased to the Alameda Food Bank on a month-to-month lease with the City since 2007. In December 2022, the Alameda Food Bank notified the City that they had ceased use of the portable located at 1900 Thau Way because the building and parking was no longer adequate to meet their needs. The Alameda Food Bank has shifted all of its operations, both warehouse and food distribution, to its Alameda Point location at 650 W. Ranger Avenue.
AGLF programs include the Do Good Community Closets program, which provides healthy snacks, clothing, hygiene products, and other essential items to children in need; the Do Good Sports Club, which provides equipment, mentoring/coaching, and transportation, at reduced or no cost to children that have been historically left out of organized sports because of these costs; and the School Incentive Program which rewards students who excel academically or show improvement in their studies. The organization works with the Alameda Unified School District and individual schools to arrange on-site closets that are open to any student and their families and educators.
DISCUSSION
The recommended lease allows AGLF to use the property for the operation and administration of their non-profit activities for four years and 11 months with no opportunity for extensions or renewals, due to the limitations imposed by the State of California Surplus Lands Act (SLA). AGLF will provide a $500 Security Deposit and pay the City $1.00 per year for the use of the land. Additionally, the lease requires AGLF to improve the landscaping conditions to enhance the exterior of the property to improve the aesthetics of the portable located at 1900 Thau Way.
SURPLUS LAND ACT
The SLA requires that a lease term be less than five (5) years unless the leased property has been fully surplused pursuant to mandatory SLA procedures. See HCD Surplus Land Act Guidelines, Section 102(h)(1). The property located at 1900 Thau Way has not yet been surplused and therefore remains subject to the SLA.
ALTERNATIVES
• Approve a lease with AGLA for 59 months for City-owned property located at 1900 Thau Way.
• Provide direction to staff on alternative terms to negotiate with AGLF.
• Direct staff to seek other prospective tenants by marketing the site.
FINANCIAL IMPACT
There is no direct financial impact to the General Fund or other City funds as the result of this lease, but the lease is a below market rate lease. The City is forgoing market rate rent, and in return, receiving the community benefit from AGLF’s work in the community.

The action is consistent with the Alameda Municipal Code.

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
RECOMMENDATION
Introduce an ordinance authorizing the City Manager to execute a 59-month lease with AGLF for City-owned property located at 1900 Thau Way, Alameda, CA.
