EXECUTIVE SUMMARY

 

Estuary Park is an 8-acre site located at 201 Mosley Avenue. Phase 1 was opened to the public in 2019. Design for Phase 2 was completed in May 2025 and put out to bid for construction in July 2025. Staff requests City Council authorize the City Manager to execute a construction agreement with McGuire and Hester, the lowest responsive bidder, in an amount not-to-exceed $5,581,440, including an 8% contingency, for the construction of the Estuary Park Phase 2 project. In addition, staff requests City Council approve the proposed budget resolution to appropriate funds between various capital sources to fully fund the project, including both construction and costs for design, geotechnical, permitting and other required services.

 

BACKGROUND

 

Estuary Park is designed to be the primary neighborhood park for Admiral’s Cove, Alameda Landing, and other nearby neighborhoods. It will also serve residents at Alameda Point, including those living at the Alameda Point Collaborative and the future RESHAP development. The first 4-acre phase of Estuary Park opened to the public in January 2019 and included two synthetic turf athletic fields. City Council approved the conceptual design of Estuary Park Phase 2 in June 2024. Phase 2 will expand the park and include amenities, such as restrooms, picnic areas, benches, drinking fountains, open lawn area, an inclusive playground, pickleball courts, basketball court, dog parks, a Bankshot all-inclusive basketball system, and a parking lot including chargers for electric vehicles. Phase 2 construction documents were completed in May 2025 and permitted in June 2025.

 

Funding for Phase 2 will be provided through $2,500,000 in previously allocated Park DIF funds, a $2,500,000 grant from the Land and Water Conservation Fund (LWCF), and various capital sources consolidated in the included budget resolution.

 

DISCUSSION

 

The City of Alameda (City) issued plans and specifications for the Estuary Park Phase 2 Project No. P.W. 02-25-03 for construction bids on July 11, 2025. To solicit the maximum number of bids and most competitive price, plans and specifications were provided to 16 separate builders exchanges throughout the Bay Area. In addition, notices were placed on the City’s web page and published in the Alameda Journal on July 11, 2025. After a bidding period of 28 days, 9 contractors submitted bids. The bids were opened on August 7, 2025, with the following results:

Public Works Staff contacted references provided by the lowest responsive bidder and received positive feedback on the ability of the company to meet the project requirements and the quality and timeliness of its work. Staff recommend executing an agreement with McGuire & Hester for a total amount of $5,581,440, which includes the base bid of $4,994,000, the costs of elective Bid Alternate #1 for (2) additional pickleball courts at $129,000, Bid Alternate #3 for (2) additional shade structures at $45,000, and an 8% contingency at $413,440. The contractor is not guaranteed any of the contingency amount and the use of the contingency will be at the sole discretion of the Public Works Director for work not originally anticipated in the plans and specifications. The agreement is attached as Exhibit 1.

 

ALTERNATIVES

 

                     Award the Agreement as presented.

                     Adjust the work in the Agreement, consistent with requirements in the public contract code.

                     Do not award the Agreement and provide alternative direction to staff.

 

FINANCIAL IMPACT

 

The Fiscal Year 2023-24budget allocated $5,000,000 to Estuary Park Phase 2 Site Improvements (CIP C52500), this included $2,500,000 from Park DIF and $2,500,000 in Grant Funding from LWCF.

 

Additional funds totaling $2,657,109 are required to meet the total construction cost of $7,657,109.

Staff proposes the project balance be funded through multiple sources including the Park DIF (Fund 306) at $855,729, excess Alameda Recreation and Park use deposits (General Fund 100, Object 23280) at $301,380, and a loan from the Sewer Services Fund 501 at $1,500,000.

 

Staff proposes that the City Manager sign a $1,500,000 promissory note to the Capital Improvement fund 310 from Sewer Services Fund 501 to be repaid by Park DIF revenues evenly over a 10-year period at a simple interest rate of four percent.

Staff requests authority to transfer $855,729 from Park DIF (Fund 306), $301,380 from excess Alameda Recreation and Park use deposits (General Fund 100, Object 23280), and $1,500,000 from Sewer Services (Fund 501) to CIP C52500 Estuary Park, which will provide the $2,657,109 in additional funding necessary for this project.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code and the City’s Strategic Plan Priority to Enhance Community Safety and Service, specifically Project CS12 to complete design and construct Estuary Park Phase 2.

 

This action is subject to the Levine Act.

 

ENVIRONMENTAL REVIEW

 

In accordance with CEQA, this action is categorically exempt from further environmental review pursuant to CEQA Guidelines Section 15301 (existing facilities), 15302 (replacement or reconstruction), and 15303 (new construction or conversion of small structures).

 

Separately, as part of the LWCF grant funding Phase 2 of the proposed project, the National Park Service (NPS) directed the City to complete cultural and biological studies to substantiate the City’s compliance with certain LWCF criteria. The California Dept. of Parks and Recreation, which manages LWCF funds on behalf of NPS, confirmed compliance with NPS criteria.

 

CLIMATE IMPACT

 

Estuary Park Phase 2 scope includes: promoting clean transportation options by incorporating EV charging stations within the new parking lot, complying with the City’s Zero Waste Implementation Plan to minimize solid waste disposal (including construction and demolition debris), minimizing the need for irrigation and, when necessary, utilizing only water-efficient irrigation systems, and mitigating excessive storm water runoff with the use of infiltration trenches and bioretention basins. In addition, and also aligned with the City’s Climate Action and Resiliency Plan, the included public restroom building will be all-electric for the purpose of reducing greenhouse gas emissions.

 

RECOMMENDATION

 

Authorize the City Manager to execute an agreement with McGuire and Hester for the Estuary Park Phase 2 Site Improvements project No. P.W. 02-25-03, in an amount not-to-exceed $5,581,440; and Adopt a resolution amending the fiscal year 2023-24 Capital Budget by increasing authorized expenditures in Capital Improvement Project C52500 by $2,657,109, Transferring $855,729 from Alameda Recreation and Parks Development Impact to C52500, transferring $301,380 from General Fund to C5250, and granting authority for the City Manager to sign a promissory note between the Sewer Service Fund and the Capital Improvement Fund in the amount of $1,500,000.
