BACKGROUND
On August 6, 2019, the City received an application for a lot line adjustment to reconfigure and transfer land between three existing adjoining parcels located at 1951 Harbor Bay Parkway within the Harbor Bay Business Park (Exhibit 1). Lot line adjustments are actions to move property line(s) between four or fewer existing adjoining parcels or to facilitate the transfer of land from one lot to adjoining lots. A lot line adjustment cannot be used to create additional parcels.
Under Alameda Municipal Code (AMC) section 30-82, lot line adjustments may be approved by resolution of the Planning Board, provided:
1. The property division is for the creation of a new property line and/or to facilitate the transfer of land from one (1) lot to adjoining lots.
2. The portion of the lot remaining after the creation of the new parcel meets all the requirements for a lot (area, width, etc.) as set forth in the City zoning regulations.
3. No street improvements or other subdivision improvements are required.
4. The proposed property division and the use of a lot adjustment map meet with the approval of both the City Engineer and Planning Director.
On September 9, 2019, the Planning Board recommended to the City Council a zoning text amendment to eliminate the requirement for Planning Board review and approval of ministerial lot line adjustments. The subject application is being processed under the current rules because the proposed amendments will not be presented to the City Council until October, and, if adopted, would not go into effect until 30 days after second reading of the ordinance.
DISCUSSION
The three subject lots are currently owned by Peet’s Coffee and Tea, which operates a roasting facility on the northern portion of the site. The southern portion of the Peet’s site, an area approximately 5.4-acres in size, remains undeveloped. This undeveloped land is currently divided into two lots. The proposed lot line adjustment will combine the two undeveloped lots into one lot. A land transfer will also adjust the shared property line between the lot containing the existing Peet’s facility (Parcel A) and the newly combined 5.1-acre vacant site (Parcel B). According to the applicant, the lot line adjustment is intended to facilitate future expansion of the adjacent bio-tech firm, Exelixis.
The City Engineer and the Planning Director have reviewed the proposed lot line adjustment and recommend approval. The resultant Parcel A and Parcel B are both consistent with the development standards for the business park C-M-PD Zoning District. The resulting lot lines for each of the parcels comply with all development standards, including building setbacks and lot coverage. The lot line adjustment application does not include any physical improvements to the site and buildings, and no street improvements or other subdivision improvements are required.
PUBLIC NOTICE
This agenda item was advertised in the Alameda Sun and public notices were posted as required by the Alameda Municipal Code. A public hearing is not required for lot line adjustments under the law.
ENVIRONMENTAL REVIEW
The action to approve a lot line adjustment is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15305(a) - Minor Alterations in Land Use Limitations.
RECOMMENDATION
Approve the Lot Line Adjustment based on findings in the draft resolution (Exhibit 2).
