EXECUTIVE SUMMARY

Staff is recommending that City Council designate Jennifer Ott, City Manager; Abby Thorne-Lyman, Base Reuse and Economic Development Director; Nicole Franklin, Base Reuse Manager; Len Aslanian, Assistant City Attorney; and Walker Toma, Community Development Manager, as the real property negotiators for the leases for Fortman and Ballena Isle Marinas, which will allow them to meet with City Council in closed session to discuss strategies, price and terms price and terms related to the lease of the premises in a manner compliant with all applicable laws and to represent the City of Alameda (City) in negotiations with a public or private party.

BACKGROUND

The City owns parcels along the northern waterfront, including where the Fortman Basin, Ltd, dba Fortman Marina, operates at 1535 Clement Avenue pursuant to existing leases. While the marina has been in operation since the beginning of the 20th Century, Fortman Marina as it is known today, was designed and built by the tenant in 1984. The current leases expire in 2029.

The City also owns parcels on the southern waterfront, including where Safe Harbor Ballena Isle operates at 1150 Ballena Boulevard pursuant to existing leases. Ballena Isle Marina was originally designed and built in 1964. The current leases that were entered into in 1979 also expire in 2029.

DISCUSSION

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Premises at Fortman and Ballena Isle marinas. Staff is recommending that City Council approve Jennifer Ott, City Manager; Abby Thorne-Lyman, Base Reuse and Economic Development Director; Nicole Franklin, Base Reuse Manager; Len Aslanian, Assistant City Attorney; and Walker Toma, Community Development Manager as the real property negotiators for the leases for these premises, which will allow them to meet with City Council in closed session to discuss price and terms for these properties in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

ALTERNATIVES

                     Approve Jennifer Ott, City Manager; Abby Thorne-Lyman, Base Reuse and Economic Development Director; Nicole Franklin, Base Reuse Manager; Len Aslanian, Assistant City Attorney; and Walker Toma, Community Development Manager as real property negotiators for the Premises.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to leasing of the premises, and thus do not identify negotiators.

 

FINANCIAL IMPACT

There is no financial impact from the approval of real property negotiators.

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

This action is consistent with the Alameda Municipal Code.  This action is subject to the Levine Act and relates to Strategic Priority TIEH26, TIEH37.

ENVIRONMENTAL REVIEW

This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.

CLIMATE IMPACTS

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

RECOMMENDATION

Approve Jennifer Ott, City Manager; Abby Thorne-Lyman, Base Reuse and Economic Development Director; Nicole Franklin, Base Reuse Manager; Len Aslanian, Assistant City Attorney; and Walker Toma, Community Development Manager as the real property negotiators for the leases of the premises located at Fortman Marina, 1535 Clement Avenue, Alameda CA 94501 and Ballena Isle Marina, 1150 Ballena Boulevard, Alameda CA 9450.
