EXECUTIVE SUMMARY
The City of Alameda (City) issued plans and specifications for bid for the Civic Center Parking Structure Renovation Project, No. P.W. 04-25-07, on May 2, 2025. The project aims to improve safety, security, cleanliness and overall functionality of the garage. Following a competitive bid process, staff recommends City Council award the proposed construction agreement to Mark Lee & Yong Kay, Inc., DBA Bay Construction Co. for an amount not-to-exceed $1,568,600.
BACKGROUND
The Civic Center Parking Structure, located at 1416 Oak Street, was built in 2007 and has since provided public parking to support downtown Alameda. The facility serves local businesses, City staff and fleet vehicles, and includes amenities such as EV charging stations, bicycle lockers, parking validation for the Alameda Theatre, monthly permit parking, an elevator, and American with Disabilities Act (ADA) accessible spaces on each level.
The facility is in need of renovation upgrades to improve safety, security, and overall functionality. To initiate these improvements, staff procured architectural services to prepare plans and specifications for the proposed work. The project includes a base bid and two bid alternates that provide flexibility on how much of the work to award.
The base bid items include installation of access control doors at ground-level vehicle entrances, pedestrian gates at ingress and egress locations, and decorative paneling for open-air sections, enabling the garage to be securely closed during non-operating hours. Additionally, upper levels of the structure will be restricted to official City vehicles and secured with motorized gates and integrated access control. The existing parking guidance system will be replaced with a modern system to provide real-time occupancy data. Identified lighting fixtures will be upgraded to energy-efficient LED technology to enhance visibility and reduce maintenance costs. Interior wall and ceiling surfaces, including stairwells, will be coated with anti-graffiti paint to promote cleanliness, enhance visibility, and deter vandalism.
The City is also addressing many physical barriers identified in its ADA Self-Evaluation and Transition Plan for this facility. Planned improvements include the addition of visual contrast markings at both stairwell treads, installation of detectable warning strips near elevator platform and stairwells, and modifications to parking stalls to meet length and van accessibility requirements. The project will also prepare to address electric vehicle charging accessibility.
Bid Alternate one includes the repair of the vandalized neon Civic Center marquee on Oak Street, while Bid Alternate two includes the repainting of the weathered north and west-facing exterior surfaces. Both bids are included in the agreement award.
DISCUSSION
To solicit the maximum number of bids and most competitive price, plans and specifications were provided to 12 separate builders’ exchanges throughout the Bay Area. Notices were placed on the City’s website and published in the Alameda Journal on April 25, 2025. A mandatory pre-bid meeting was held at the Civic Center Parking Structure on May 12, 2025, with 16 prospective bidders in attendance. Bids were opened on June 2, 2025. After a bidding period of 30 days, two (2) contractors submitted bids. The bid result is as follows:

Major One Construction, Inc. submitted a non-responsive bid by not meeting the requirements of the bid documents by having at least five years of experience as a California licensed contractor.
Public Works staff reviewed the bid submitted by Bay Construction Co. and determined that a responsive bid was submitted. Staff contacted representative references provided by Bay Construction Co. and received positive feedback on the ability of the company to meet the project requirements, quality, and timeliness of their work.
Staff recommends awarding an agreement to Mark Lee & Yong Kay, Inc. DBA Bay Construction for a total amount of $1,568,600, which includes Bid Alternate No. 1, Bid Alternate No. 2, and a 10% contingency amount of $142,600. The contractor is not guaranteed any of the contingency amount and use of the contingency will be at the sole discretion of the City for work not originally anticipated in the plans and specifications. The specifications also informed the successful bidder that they shall pay not less than the prevailing rate of per diem as determined by the Director of the California Department of Industrial Relations. The Agreement is attached as Exhibit 1.
ALTERNATIVES
• Award the Agreement as presented.
• Adjust or modify scope within the Agreement.
• Reject all bids and do not award the construction Agreement. Should the City Council choose to reject all bids, staff would be required to initiate a new competitive bidding process. This action would likely result in a significant delay to the project timeline and would likely increase overall project costs due to market fluctuations and additional administrative efforts.
FINANCIAL IMPACT
The Civic Center Parking Structure Improvements Project is funded through Capital Improvement Project (CIP) C44000 - Parking. Funds are available within the CIP allocation to cover all contractual expenses associated with this project. There is no impact to the General Fund.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
The City Council adopted the 2023-2026 City of Alameda Strategic Plan, which includes the following:
• Design and construct Civic Center Garage safety improvements (TIE18)
Alameda Municipal Code Chapter 8 contains parking prohibitions and Chapter 12 covers use of the parking fund, parking zones, off-street parking lots including garage parking structures.
This action is subject to the Levine Act.

In accordance with CEQA, this action is categorically exempt from further environmental review pursuant to CEQA Guidelines Section; 15301 (Existing Facilities)
CLIMATE IMPACT
There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
RECOMMENDATION
Authorize the City Manager to execute a construction agreement with Mark Lee & Yong Kay, Inc., DBA Bay Construction Co. for the Civic Center Parking Structure Renovation Project, No. P.W. 04-25-07, in an amount not-to-exceed $1,568,600, including contingency.
