EXECUTIVE SUMMARY

 

Staff is recommending that City Council designate City Manager, Eric Levitt, Community Development Director, Lisa Maxwell, and Development Services Division Manager, Lois Butler, as the real property negotiators for the Marina Village Inn located at 1151 Pacific Marina, Alameda (the Property), which will allow them to meet with City Council in closed session to discuss price and terms related to the potential purchase of the Property in a manner compliant with all applicable laws and to represent the City of Alameda (City) in negotiations with a public or private party.

 

BACKGROUND

 

There is a need for homeless housing in Alameda. The Property is being considered for such housing. Staff recommends that City Council designate City Manager, Eric Levitt, Community Development Director, Lisa Maxwell, and Development Services Division Manager, Lois Butler, as the real property negotiators for the Property, which will allow them to meet with City Council in closed session to discuss price and terms related to the potential purchase of this Property in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, the City Council must identify, in an open and public session, the real property negotiators for negotiations concerning real property, such as the Property. Staff recommends that the negotiators for negotiations related to the Property include Eric Levitt, City Manager; Lisa Maxwell, Community Development Director, and Lois Butler, Development Services Division Manager. This will allow those individuals to negotiate on the City’s behalf, based on direction provided by the City Council.

ALTERNATIVES

 

                     Approve Eric Levitt, Lisa Maxwell and Lois Butler as real property negotiators for the Property.

                     Identify other staff as negotiators.

                     Choose not to negotiate for the Property and thus do not identify negotiators.

 

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

Approval of real property negotiators is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301, as it involves the negotiation of the price and terms of a lease.

 

CLIMATE IMPACTS

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

 

RECOMMENDATION

 

Approve Eric Levitt, City Manager, Lisa Maxwell, Community Development Director, and Lois Butler, Development Services Division Manager, as Real Property Negotiators for the Marina Village Inn located at 1151 Pacific Marina, Alameda, CA 94501.

 

CITY MANAGER RECOMMENDATION

 

The City Manager concurs with staff recommendation.
