In accordance with the California Environmental Quality Act (CEQA), this project is exempt from CEQA review under CEQA Guidelines sections 15308 (not a project), 15061(b)(3) (common law sense exemption) and 15308 (Actions by Regulatory Agencies for Protection of the Environment). (Public Works 265)

AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING SECTION 8-8.9 (ELECTRIC VEHICLE CHARGING) TO ARTICLE 8-8 (GENERAL PARKING REGULATIONS) OF CHAPTER VIII (TRAFFIC, MOTOR VEHICLES AND ALTERNATIVE TRANSPORTATION MODES), TO LIMIT THE USE OF DESIGNATED PARKING SPACES AT CURBSIDE LOCATIONS AND CITY-OWNED PARKING FACILITIES TO ELECTRIC VEHICLES THAT ARE CONNECTED FOR ELECTRIC CHARGING PURPOSES
WHEREAS, the City Council desires to limit the use of designated parking spaces at curbside locations and city-owned parking facilities to electric vehicles that are connected for electric charging purposes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALAMEDA DOES HEREBY ORDAIN AS FOLLOWS:
Section 1: LOCAL AMENDMENTS TO ALAMEDA MUNICIPAL CODE
Article 8-8 (GENERAL PARKING REGULATIONS) of Chapter VIII (TRAFFIC, MOTOR VEHICLES AND ALTERNATIVE TRANSPORTATION MODES) of the Alameda Municipal Code, is hereby amended to add (underlined for additions):
8-8.9 - ELECTRIC VEHICLE CHARGING.
The Public Works Director is hereby authorized to limit the use of designated parking spaces at curbside locations and City-owned parking facilities to electric vehicles that are connected for electric charging purposes. The Public Works Director shall cause to be installed and maintained appropriate signage to designate such spots. It shall be unlawful for any person to stop, park, or leave standing, any vehicle in such designated space unless it is connected to the electric charger.
Section 2: PARKING PENALTY
The Parking Penalty Schedule for the City of Alameda is hereby amended to establish an initial penalty for violation of Alameda Municipal Code section 8-8.9 of $45.00. Modifications to this amount may be made by resolution.
Section 3: IMPLIED REPEAL
Any provision of the Alameda Municipal Code inconsistent with this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to the extent necessary to effectuate this Ordinance.
Section 4: CEQA DETERMINATION
This action is exempt from CEQA pursuant to CEQA Guidelines section 15061(b)(3) (common sense exemption) and is not a project under CEQA Guidelines section 15378 in that the standards set forth in the ordinance promote electric vehicle usage and are thus protective of the environment with no possibility that the activity in question may have a significant effect on the environment. As a separate and independent basis, this action is exempt from CEQA pursuant to CEQA Guidelines section 15308 in that the standards set forth in the ordinance assure the maintenance, restoration, enhancement or protection of natural resources and the environment.
Section 5: SEVERABILITY
If any provision of this Ordinance is held by a court of competent jurisdiction to be invalid, this invalidity shall not affect other provisions of this Ordinance that can be given effect without the invalid provision and therefore the provisions of this Ordinance are severable. The City Council declares that it would have enacted each section, subsection, paragraph, subparagraph and sentence notwithstanding the invalidity of any other section, subsection, paragraph, subparagraph or sentence.
Section 6: EFFECTIVE DATE
This Ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
