E XECUTIVE SUMMARY

 

Staff is recommending that City Council designate City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Strategic Advisor Andrew Thomas, Ted Anderson, Managing Director, Cushman & Wakefield,, and Assistant City Attorney Len Aslanian, as the real property negotiators for 1605 Ferry Point, Alameda (Premises), which will allow them to meet with City Council in closed session to discuss price and terms related to occupancy of the Premises in a manner compliant with all applicable laws (including the Surplus Lands Act) and to represent the City of Alameda (City) in negotiations with a public or private party.

 

B ACKGROUND

 

US Ecology, Inc. (US Ecology), formally known as NRC Environmental Services, Inc., provides environmental, emergency and disaster response services for hazardous materials. US Ecology leases Building 15, located at 1605 Ferry Point at Alameda Point. The Premises is used for administrative offices, storage of vessels, and general storage of equipment, supplies and vehicles. The term of the lease with US Ecology commenced on July 1, 2016. The initial term of the lease expired June 30, 2021 and the tenant is currently occupying the Premises pursuant to a month-to-month tenancy. The lease provides no extension options.

 

Staff is recommending that City Council designate City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Strategic Advisor Andrew Thomas, Ted Anderson, Managing Director, Cushman & Wakefield,, and Assistant City Attorney Len Aslanian, as the real property negotiators for 1605 Ferry Point, Alameda, which will allow them to meet with City Council in closed session to discuss price and terms for this property in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

 

D ISCUSSION

 

Under Government Code Section 54956.8, the City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Premises. Staff recommends that the negotiators for negotiations related to the Premises include Jennifer Ott, City Manager, Abigail Thorne-Lyman, Base Reuse and Economic Development Director, Andrew Thomas, Strategic Advisor, Ted Anderson, Managing Director, Cushman & Wakefield, and Len Aslanian, Assistant City Attorney. This will allow those individuals to negotiate on the City’s behalf, based on direction provided by the City Council.

 

A LTERNATIVES

 

                     Approve Jennifer Ott, City Manager, Abigail Thorne-Lyman, Base Reuse and Economic Development Director, Andrew Thomas, Strategic Advisor, Ted Anderson, Managing Director, Cushman & Wakefield, and Len Aslanian, Assistant City Attorney, as real property negotiators for the Premises.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to occupancy of the Premises, and thus do not identify negotiators.

 

F INANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

This action is consistent with the Alameda Municipal Code.

 

E NVIRONMENTAL REVIEW

 

This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.
