EXECUTIVE SUMMARY
Staff is recommending that City Council designate City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Management Analyst Annie Cox, and Assistant City Attorney Len Aslanian as the real property negotiators for Building 20, located at 2701 Monarch Street, Alameda, which will allow them to meet with City Council in closed session to discuss price and terms related to a lease of the premises in a manner compliant with all applicable laws and to represent the City of Alameda (City) in negotiations with a public or private party.
BACKGROUND
Auctions by the Bay (Auctions) is a full service West Coast auction house specializing in the appraisal and sale of antiques and fine art. It has been a tenant at Alameda Point since 2001. Auctions began occupying Building 20 in 2010 under a license agreement and entered into a lease for Building 20 in 2012. The lease has been amended three times. In 2013, the First Amendment clarified the renewal terms of the lease. The March 2022 Second Amendment implemented the City’s Covid-19 rent deferral program. Auctions exercised the lease’s renewal option, and with the December 2022 Third Amendment, the lease term was extended through the end of 2032.
DISCUSSION
Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Premises. Staff is recommending that City Council approve City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Management Analyst Annie Cox, and Assistant City Attorney Len Aslanian as the real property negotiators for the lease of Building 20, located at 2701 Monarch Street, Alameda, which will allow them to meet with City Council in closed session to discuss price and terms for this property in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.
ALTERNATIVES
• Approve City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Management Analyst Annie Cox, and Assistant City Attorney Len Aslanian as the real property negotiators for the Premises.
• Identify other staff as negotiators.
• Choose not to negotiate terms related to a lease of the premises, and thus do not identify negotiators.
FINANCIAL IMPACT
There is no financial impact from the approval of real property negotiators.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action is consistent with the Alameda Municipal Code. This action is subject to the Levine Act and relates to Strategic Priority TIE 25 (Implement the City’s Alameda Point Disposition Strategy - renting and leasing City Properties) and TIE26 (Expand Citywide business economic development activities, including Alameda Point attraction and retention).
ENVIRONMENTAL REVIEW
This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.
CLIMATE IMPACTS
There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
RECOMMENDATION
Approve City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Management Analyst Annie Cox, and Assistant City Attorney Len Aslanian as the real property negotiators for the lease of the premises located at 2701 Monarch Street, Alameda (Building 20).
