EXECUTIVE SUMMARY

 

The State of California requires the City Council to designate authorized agents to engage with the Federal Emergency Management Agency (FEMA) and the California Governor’s Office of Emergency Services (CalOES) for the purposes of obtaining certain grants, including but not limited to any of the following:

 

                     Federally declared Disaster (DR), Fire Mitigation Assistance Grant (FMAG), California State Only Disaster (CDAA), Immediate Services Program (ISP), Hazard Mitigation Grant Program (HMGP), Building Resilient Infrastructure and Communities (BRIC), Legislative Pre-Disaster Mitigation Program (LPDM), under Public Law 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state financial assistance under the California Disaster Assistance Act.

                     Flood Mitigation Assistance Program (FMA), under Section 1367 of the National Flood Insurance Act of 1968, 42 U.S.C. § 4104d.

                     National Earthquake Hazards Reduction Program (NEHRP) 42 U.S.C. §  7704 (b)(2)(A)(iv) and 42 U.S.C. § 7704 (b)(2)(B) National Earthquake Hazards Reduction Program, and also The Consolidated Appropriations Act, 2018, Div. F, Department of Homeland Security Appropriations Act, 2018, Pub. L. No. 115-141

                     California Early Earthquake Warning (CEEW) under California Government Code Sections 8587.8, 8587.11, and 8587.12.

A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted. The City of Alameda (City) previously designated authorized agents for this purpose on January 3, 2023 (Resolution 16022).

 

BACKGROUND

 

The City previously applied for and received FEMA grants for various disaster response and mitigation purposes. Staff is recommending the authorized agents remain the City Manager, Finance Director, Public Works Director and Fire Chief.

 

DISCUSSION

ALTERNATIVES

 

                     Adopt the Resolution.

                     Select different authorized agents.

                     Do not select any authorized agents, however not selecting any authorized agents will mean the City cannot execute disaster and mitigation grants with FEMA.

 

FINANCIAL IMPACT

 

The action item does not have financial impact, but failing to designate authorized agents could jeopardize current and future grant reimbursements.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.

 

CLIMATE IMPACT

 

Designating authorized agents will allow the City to accept current and future grants with FEMA which can address the impacts of climate change.

 

RECOMMENDATION

 

Adopt a resolution designating Authorized Agents for the purpose of obtaining certain current or future grants from the Federal Emergency Management Agency (FEMA) and the California Governor’s Office of Emergency Services (CalOES).
