MINUTES OF THE OPEN GOVERNMENT COMMISSION MEETING

Chair Miley convened the meeting at 7:00 p.m.
ROLL CALL - Present: Commissioners Bowling, Harris, Shwartz, Tilos and Chair Miley - 5.
Absent: None.

REGULAR AGENDA ITEMS
3-A. Selection of Chair and Vice Chair
Commissioner Shwartz moved approval selecting Vice Chair Bowling as the new Chair.
Chair Miley seconded the motion, which carried by the following roll call vote: Commissioners Bowling: Aye; Harris: Aye; Shwartz: Aye; Tilos: Aye; and Chair Miley: Aye; Ayes: 5.
Commissioner Shwartz moved approval selecting Commissioner Harris as the new Vice Chair.
Commissioner Tilos seconded the motion, which carried by the following roll call vote: Commissioners Bowling: Aye; Harris: Aye; Shwartz: Aye; Tilos: Aye; and Chair Miley: Aye; Ayes: 5.
3-B. Minutes of the October 6, 2025 Meeting
Commissioner Harris moved approval of the minutes.
Commissioner Shwartz seconded the motion, which carried by the following roll call vote: Commissioners Bowling: Aye; Harris: Aye; Shwartz: Aye; Tilos: Aye; and Chair Miley: Aye; Ayes: 5.
3-C. Approve the 2025 Annual Report
The Commission discussed the Annual Report and the City Clerk responded to questions.
Speaker:
Jay Garfinkle, Alameda, stated the City Attorney’s Office refuses to explain redactions; urged that the City Attorney’s Office be advised or instructed to explain redactions.
Commissioner Shwartz moved approval of the Annual Report.
Vice Chair Bowling seconded the motion, which carried by the following roll call vote: Commissioners Bowling: Aye; Harris: Aye; Shwartz: Aye; Tilos: Aye; and Chair Miley: Aye; Ayes: 5.
STAFF UPDATE
The City Clerk noted that the Sunshine Ordinance prohibits complaints from being accepted when filed against a member of the City Council or an officially declared candidate within 45 days of a City election; for the November 3 election, such complaints would not be accepted starting September 19.
NON-AGENDA PUBLIC COMMENT
Jay Garfinkle, Alameda, discussed candidates running for office; stated the policy should also apply to unfavorable comments made against Councilmembers.
