EXECUTIVE SUMMARY

 

The South Shore Lagoon System serves private recreational and aesthetical purposes and is a storm drain collection and detention facility for the City of Alameda (City). The cost of maintenance and repair of the lagoon system is shared by the Alameda West Lagoon Home Owners’ Association (AWLHOA) and the City, as specified in the 2017 Amended and Restated Agreement included in Exhibit 1. The Bayview Weir is a large concrete structure with gates that can be raised or lowered depending if water needs to be brought in or drained out of the lagoon system. Per the Amended and Restated Agreement, the cost of the Bayview Weir is 100% City responsibility. The stems and operating mechanisms of the 11 gates at the Bayview Weir require replacement to ensure reliable operation.  The City issued a Request for Proposal (RFP) for this service and recommends the award of the contract to Power Engineering Construction Company in an amount not to exceed $294,184, which includes a 10% contingency.

 

BACKGROUND

 

The South Shore Lagoon System was created in the 1950s, when tidelands south of Alameda Island were filled in to create the South Shore Development, thus leaving a water gap for the new lagoons.  The homeowners along the newly constructed frontage of the lagoons formed the AWLHOA for the purpose of raising funds and maintaining the lagoons. On November 25, 1964, the City and the AWLHOA entered into an agreement to set forth the rights and responsibilities of each party in connection with lagoon operations, maintenance, and repair. This agreement was amended in 1968 and 1996 and 2017 (Amended and Restated Agreement).

 

The land under the lagoon system is owned by the AWLHOA, with a storm water easement to allow the City access for maintenance. Access to the lagoons is limited to members of the AWLHOA, the water-front property owners on the Gold Coast, and City staff. In addition to serving private recreational and aesthetical purposes, the lagoon system is a storm drain collection, detention, and treatment facility for the City. For that reason, the cost of maintenance and repair of the lagoon system is shared by the AWLHOA and the City, as specified in the Amended and Restated Agreement.

 

Circulation of water through the lagoons is provided by pumping salt water from an intake pipe in the San Francisco Bay into the westernmost lagoon, near Crown Beach.  This water then travels by gravity east through the five lagoons that compose the lagoon system and returns to the Bay via an outfall at Bayview Drive.  There are two leveling structures or “weirs”, one at Willow and the other at Bayview, just upstream of the outfall.

 

The Bayview weir is a large concrete structure with gates that can be raised or lowered depending if water needs to be brought in or drained out of the lagoon system. The elevation of the structure is such that with a tide of 4.5’ or lower, the lagoons can drain, as needed. Per the Amended and Restated Agreement, the cost of the Bayview Weir is 100% City responsibility.

 

DISCUSSION

 

Staff prepared and published a Request for Proposal soliciting a qualified contractor to replace 11 gate stem and operating mechanisms at the Bayview Weir. The RFP was published on March 23, 2023, advertised in the Alameda Sun, and after a submittal period of 22 days received, one proposal was received.  The proposal results are as follows:

After review of the submitted proposal and verification of references, staff recommends awarding the contract to Power Engineering Construction Company for a total amount of $294,184, which includes a 10% contingency in the amount of $26,744.  The contractor is not guaranteed any of the contingency and its use will be at the sole discretion of the Public Works Director for work not originally anticipated in the specification.  A copy of the contract is attached as Exhibit 2.

 

ALTERNATIVES

 

                     Award the contract as recommended.

                     Adjust or modify the scope within the contract.

                     Do not award this contract and give another direction to staff. Delay of this work may cause operational issues in managing water levels in the lagoons.

 

FINANCIAL IMPACT

 

The project is budgeted in the Capital Improvement Program (CIP) under Lagoon Maintenance (C34000).  No additional budget appropriations are needed. There is no impact to the General Fund.

This action is consistent with the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

This action is exempt from environmental review pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15301 (Existing Facilities) and 15302 (Replacement or Reconstruction).

 

CLIMATE IMPACT

 

Construction of materials and delivery of equipment will have greenhouse gas emission impacts.  However, with more extreme and frequent storms predicted with climate change, reliable operation of the leveling gates at the Bayview Weir is essential. 

 

RECOMMENDATION

 

Authorize the Assistant City Manager to execute an agreement with Power Engineering Construction Company in an amount not to exceed $294,184 for replacement of gate stems and operators at the Bayview Leveling Structure
