EXECUTIVE SUMMARY

 

Staff is recommending that City Council designate Amy Wooldridge, Assistant City Manager, Justin Long, Recreation and Parks Department Director, Matt Nowlen, Recreation and Parks Department Assistant Director, and Daniel Turner, Deputy City Attorney, as the real property negotiators to discuss a potential Exclusive Negotiating Agreement (ENA) for a Surf Park at Enterprise Park (Premises), bordered by West Hornet Avenue, the San Francisco Bay, the WETA Facility and the paved access road to the Encinal Boat Launch on parcels 74-1369-5-1 and 74-1369-21-7 in Alameda, California and including the old Navy recreation building at 150 West Hornet Avenue, which will allow them to meet with City Council in closed session to discuss price and terms related to a potential ENA to develop and operate a Surf Park at the Premises in a manner compliant with all applicable laws and to represent the City of Alameda (City) in negotiations with a public or private party.

 

BACKGROUND

 

Enterprise Park is an open space parcel that includes the Encinal Boat Launch Facility, Encinal Beach, a portion of the San Francisco Bay Trail, a large parking lot closed to the public and used for trainings, old Navy campground, open space and a portion of the CSI Mini Storage facility. Staff coordinated public outreach with the Neptune Beach Surf Club Development Partners, LLC (NBSC) to gauge the community’s interest in a Surf Park at Enterprise Park.

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Premises. Staff is recommending that City Council approve Amy Wooldridge, Assistant City Manager, Justin Long, Recreation and Parks Department Director, Matt Nowlen, Recreation and Parks Department Assistant Director, and Daniel Turner, Deputy City Attorney, as the real property negotiators to discuss a potential ENA for a portion of the Premises, which will allow them to meet with City Council in closed session to discuss price and terms for this property in a manner compliant with all applicable laws and to represent the City in negotiations with a public or private party.

 

ALTERNATIVES

 

                     Approve Amy Wooldridge, Assistant City Manager, Justin Long, Recreation and Parks Department Director, Matt Nowlen, Recreation and Parks Department Assistant Director, and Daniel Turner, Deputy City Attorney, as real property negotiators for the Premises.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to an Exclusive Negotiating Agreement of the premises, and thus do not identify negotiators.

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

This action is consistent with the Alameda Municipal Code.  This action is subject to the Levine Act and relates to Strategic Priority to Enhance Community Safety and Services.

 

ENVIRONMENTAL REVIEW

 

This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.

 

CLIMATE IMPACTS

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
