RESHAP Development Agreement Annual Review - Applicants: MidPen Housing etal.  Public hearing to consider a request for a periodic review of the RESHAP Project Development Agreement. The consideration of an Annual Report is not a project under the California Environmental Quality Act (CEQA). No further environmental review is required.

EXECUTIVE SUMMARY

 

Alameda Municipal Code Section 30-95.1 requires the Planning Board to conduct a public hearing at which the applicant must demonstrate good faith compliance with the terms and conditions of any Development Agreement.  MidPen Housing, and on behalf of their collaborating partners (Alameda Point Collaborative, Building Futures With Women and Children, and Operation Dignity), has submitted a letter demonstrating their good faith compliance with the terms and conditions of their Development Agreement, as amended.  (Exhibit 1)

 

Staff is recommending that the Planning Board approve the annual report and find that the developers have complied in good faith with the terms and conditions of the Development Agreement.  The Development Agreement can be found on the City of Alameda website at:

BACKGROUND

 

In June 2018, the City of Alameda and MidPen Housing etal entered into a Development Agreement (DA) for the project. In December 2023, the City and MidPen Housing entered into an amended DA to increase the number of units from 267 to 309, all of which will be deed restricted as affordable to serve extremely low-income, very low, and low-income residents by providing housing and supportive services that will help to break the cycle of homelessness and establish stability and opportunity in the lives of residents and create a cohesive, pedestrian-friendly, and inviting community.

 

The amended agreement also relocated the development site within the master development area north of Midway, in the Main Street Specific Plan area, and includes substantial cooperation with and participation by the adjacent market-rate master developer, Brookfield/Catellus. This report provides a status on the activities associated with the DA and the status of the project covering the annual review period from January 1, 2024 to December 31, 2024.  The developer has submitted a letter demonstrating their good faith compliance with the terms and conditions of the DA.  (Exhibit 1)

 

DISCUSSION

 

Since executing the amended DA in December 2023, the developer and City have accomplished the following:

 

                     Demolition and surcharge plans finalized

                     Backbone infrastructure plans finalized

                     Demolition of on-site buildings and Navy infrastructure

                     Site preparation initiated

                     Site layout, building design and programming completed

                     Ministerial design review plans submitted for Stardust Gardens (Phase 1A)

                     Ministerial design review plans submitted for Harbor Village (Phase 1B)

                     General contractor selection process completed

                     Funds awarded from Alameda County Measure A-1

                     Funds awarded from Affordable Housing Program

                     Funds awarded from City of Alameda Permanent Loan Housing Allocation

 

 

From staff’s perspective, MidPen Housing has complied in good faith with the terms and conditions of the DA for the period from January 1, 2024 to December 31, 2024.

 

ENVIRONMENTAL REVIEW

 

The action requested is an informational item. Development Agreement annual review is not a project as defined in the CEQA Guidelines Section 15378, as there is no possibility of a physical effect on the environment.

 

RECOMMENDATION

 

Approve the draft resolution (Exhibit 2) finding that the developer has demonstrated good faith compliance with the terms and conditions of the Development Agreement.
