EXECUTIVE SUMMARY

 

Staff is recommending that City Council/SACIC designate City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Economic Development Division Manager Dwayne Dalman, Assistant City Attorney Len Aslanian and David Doezema, Keyser Marston, as the real property negotiators for the lease and loans  for the Alameda Theater & Cineplex located at 2317 Central Avenue, Alameda, which will allow them to meet with City Council/SACIC in closed session to discuss price and terms of the lease and loans, and potential future real transactions related to the operation of the theater in a manner compliant with all applicable laws and to represent the City of Alameda (City)/SACIC in negotiations with a public or private party.

 

BACKGROUND

 

The Alameda Theatre is an Art Deco movie theatre built in 1932 and located at 2317 Central Avenue.  A restoration and expansion project was completed in 2008, making the historic theater the primary anchor of an eight-screen multiplex.  The operator of the theater secured a bank loan as well as two loans from the SACIC to complete the restoration and expansion, and currently leases a portion of the property from the City. 

 

DISCUSSION

 

Under Government Code Section 54956.8, Title 5, Division 2, Part 1, Chapter 9, City Council/SACIC must identify, in an open and public session, the real property negotiators for negotiation of the price and terms concerning real property, such as the Premises. Staff is recommending that City Council approve City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Economic Development Division Manager Dwayne Dalman, Assistant City Attorney Len Aslanian and David Doezema, Keyser Marston as the real property negotiators for the lease and loans for the premises, which will allow them to meet with City Council/SACIC in closed session to discuss lease and loan terms for this property in a manner compliant with all applicable laws and to represent the City/SACIC in negotiations with a public or private party.

 

ALTERNATIVES

 

                     Approve City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Economic Development Division Manager Dwayne Dalman, Assistant City Attorney Len Aslanian and David Doezema, Keyser Marston as real property negotiators for the Premises.

                     Identify other staff as negotiators.

                     Choose not to negotiate terms related to price and terms of the lease and loans for the Alameda Theater & Cineplex premises and thus do not identify negotiators.

 

FINANCIAL IMPACT

 

There is no financial impact from the approval of real property negotiators.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code.  This action is subject to the Levine Act.

 

ENVIRONMENTAL REVIEW

 

This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.

 

CLIMATE IMPACTS

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.

 

RECOMMENDATION

 

Approve City Manager Jennifer Ott, Base Reuse and Economic Development Director Abigail Thorne-Lyman, Economic Development Division Manager Dwayne Dalman, Assistant City Attorney Len Aslanian and David Doezema, Keyser Marston as the real property negotiators for the price and terms of the lease of the Alameda Theater & Cineplex premises located at 2317 Central Avenue, Alameda.
