CITY OF ALAMEDA ORDINANCE NO. _____

 

AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE WITH LONGSHOT SPACE TECHNOLOGIES CORPORATION, A DELAWARE CORPORATION, FOR A TERM OF THIRTY-SEVEN MONTHS FOR A PORTION OF BUILDING 29 KNOWN AS SUITE 200, LOCATED AT 1701 MONARCH STREET, AT ALAMEDA POINT

 

                     WHEREAS, Building 29, located at 1701 Monarch Street, is an approximately 19,480 square-foot former Naval workshop and gun-testing facility, with an unusual size and configuration that is only usable by a limited pool of businesses; and

 

                     WHEREAS, the workshop portion of Building 29 is currently leased by Dreyfuss Capital Partners, LLC., and used by a variety of metalworkers and craftspeople; and

 

                     WHEREAS, Building 29 is slated for eventual demolition as part of the future DePave Park; and

 

                     WHEREAS, Longshot Space Technologies, Inc., a Delaware Corporation (Longshot) is a start-up company developing a non-rocket-based satellite launcher that uses a linear accelerator tube instead of traditional vertical lift and Longshot’s prototype accelerator is uniquely suited for the gun-testing portion of the Building; and

 

WHEREAS, Longshot wishes to enter into a lease for a portion of Building 29 for a term of thirty-seven (37) months; and

 

                     WHEREAS, the leased premises include approximately 9,200 square-feet of interior space, and 7,400 square-feet of adjacent yard space; and

 

                     WHEREAS, the total monthly base rent for the first year is $5,670, the monthly base rent shall increase by 3.5%, to $5,868.00 per month starting in the second year, and $6,074.00 per month in the third, with the first month of rent abated.

 

 

NOW, THEREFORE, the City Council of the City of Alameda does hereby ordain as follows:

 

                     Section 1.  The City Manager of Alameda is hereby authorized to execute on behalf of the City of Alameda a lease agreement with Longshot Space Technologies, Inc., a Delaware corporation, for a portion of Building 29 located at 1701 Monarch Street, Suite 200, at Alameda Point, Alameda California, for a term of thirty-seven (37) months subject to such technical or clarifying revisions as are reasonably determined necessary by the City Manager and approved by the City Attorney, and the City Clerk is hereby authorized and direct to attest to the same.

 

Section 2.  If any section, subsection, sentence, clause or phrase of this ordinance if, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council of the City of Alameda hereby declares that it would have passed this ordinance, and each section, subsections, clause, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases are declared to be invalid and unconstitutional.

 

Section 3.  This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
