AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING SECTION 12-2.3 (LOCATION) OF ARTICLE I (PARKING LOTS) OF CHAPTER XII (DESIGNATED PARKING) AND BY REPEALING AND REPLACING CURRENT SECTION 12-4.12 (RESERVED) OF ARTICLE I (PARKING LOTS) IN ITS ENTIRETY TO AUTHORIZE THE CITY MANAGER OR THEIR DESIGNEE TO ESTABLISH AND MODIFY HOURS OF OPERATION FOR THE CIVIC CENTER PARKING STRUCTURE
WHEREAS, Section 12-2.3 of the Alameda Municipal Code references a City employee parking lot location that no longer exists and has since been redeveloped; and
WHEREAS, amendment of the Alameda Municipal Code to remove outdated location references will improve the City’s ability to manage parking resources effectively; and
WHEREAS, the City of Alameda owns and operates the Civic Center Parking Structure as a public parking facility intended to serve visitors, employees, and members of the public; and
WHEREAS, the effective management of public parking facilities requires that City staff retain the ability to set and modify hours of operation in response to changing parking demand, operational needs, public safety considerations, and facility maintenance activities; and
WHEREAS, the Alameda Municipal Code does not currently establish the Public Works Director’s authority to set and modify hours of operation for the Civic Center Parking Structure; and
WHEREAS, amendment of the Alameda Municipal Code to establish such authority will promote efficient use of the facility, enhance public safety, and support the City’s overall parking management objectives.
NOW, THEREFORE, the City Council of the City of Alameda does hereby ordain as follows:
Section 1. Section 12-2.3 (Location) of Chapter XII (Designated Parking) of the Alameda Municipal Code is hereby amended to read as follows:
12-2.3. Reserved.
The area referred to herein as the City employees' parking lot is located on the south side of Lincoln Avenue at 2216 Lincoln Avenue.
Section 2. The current version of Alameda Municipal Code Section 12-4.12 (Reserved) of Article I (Parking Lots) of Chapter XII (Designated Parking) is hereby repealed in its entirety, and replaced with the following provisions:
12-4.12. Civic Center Parking Structure Hours of Operation.
A. The City Manager or their designee is hereby authorized to establish and modify the hours of operation for the Civic Center parking structure from time to time as necessary to support public safety, maintenance activities, and efficient parking operations. The established hours of operation shall be posted on-site.
B. It shall be unlawful for any person to park, leave, or occupy a vehicle in the Civic Center parking structure outside of the posted hours of operation, except as authorized by the City Manager or their designee.
C. Vehicles left in the facility outside of posted hours of operation are subject to citation or other enforcement action.
Section 3. CEQA DETERMINATION
In accordance with the California Environmental Quality Act (CEQA), the City Council finds and determines that the adoption of this ordinance is categorically exempt from further environmental review pursuant to CEQA Guidelines section 15301 (Existing Facilities).
Section 4. SEVERABILITY
If any provision of this Ordinance is held by a court of competent jurisdiction to be invalid, this invalidity shall not affect other provisions of this Ordinance that can be given effect without the invalid provision and therefore the provisions of this Ordinance are severable. The City Council declares that it would have enacted each section, subsection, paragraph, subparagraph and sentence notwithstanding the invalidity of any other section, subsection, paragraph, subparagraph or sentence.
Section 5. IMPLIED REPEAL
Any provision of the Alameda Municipal Code inconsistent with this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to the extent necessary to effectuate this Ordinance.
Section 6. EFFECTIVE DATE
This ordinance shall be in full force and effect from and after the expiration of thirty (30) days from the date of its final passage.
