EXECUTIVE SUMMARY

 

This report recommends authorizing the City Manager to execute a 24-month contract with Ghirardelli Associates (Ghirardelli) in the amount of $452,904 for construction management services for the Seaplane Lagoon Ferry Terminal project at Alameda Point.

 

In accordance with the Disposition and Development Agreement (DDA) for Site A, the Developer, Alameda Point Partners (APP), is responsible for constructing the ferry terminal at Seaplane Lagoon as part of the Phase 1 Infrastructure.  Ghirardelli will act as the City of Alameda’s (City) representative/construction manager providing the oversight and quality assurance for construction of the ferry terminal project.

 

BACKGROUND

 

On June 16, 2015, the City Council approved a DDA with APP, for the Site A development, consisting of a 68-acre mixed-use project at the gateway of Alameda Point.  As part of the backbone infrastructure within the Site A Phase 1 development, APP and the City agreed to cooperate in the design, permitting, and construction of a new ferry terminal at Seaplane Lagoon (Seaplane Lagoon Ferry Terminal) and APP agreed to contribute $10 million towards its development.  Consistent with the DDA, the City is responsible for obtaining third party permits and approvals necessary for construction and operation of the Seaplane Lagoon Ferry Terminal and APP is obligated to complete the construction of the new terminal.

 

In August 2018, City staff conducted a selection process for a consultant specializing in ferry construction to assist City staff during the design and pre-construction phase of the ferry terminal project.  Staff was given the name of two highly experienced firms from the Water Emergency Transportation Authority (WETA).  After interviewing both firms, staff selected Ghirardelli Associates.

 

Ghirardelli was founded in 1999 and is a premier construction management company serving local agencies throughout California, including cities, counties, regional transportation agencies, mass transit, and port agencies.  Ghirardelli has specific, relevant experience working with WETA on a number of projects, including the Richmond Ferry Terminal, South San Francisco Oyster Point Ferry Terminal, Pier 9 Lay-over Berthing Facility and Passenger Float Construction. 

 

Mr. William Davis was the lead construction manager on the projects above and is currently consulting with the City on the pre-construction phase of the ferry terminal project. Mr. Davis has been with Ghirardelli Associates for 12 years and has forty-one years of experience in underwater construction/repair, project and construction management inspection, civil construction, marine construction and environmental response.

 

DISCUSSION

 

The three parties involved in the Seaplane Lagoon Ferry Terminal project - City, APP and WETA - agree that a third-party construction manager and inspector is desirable to provide oversight and quality assurance on various aspects of the construction phase of the Seaplane Lagoon Ferry Terminal, including, but not limited to, contract procurement, construction management, monitoring of project budget and payments, and tracking project schedule.

 

Given the familiarity and specialized knowledge of Ghirardelli, and in particular Mr. Davis’ experience with the Seaplane Lagoon Ferry Terminal project, the parties recommend that Mr. Davis continue on the project as construction manager for the City.

 

The scope of work for Ghirardelli and Mr. Davis is included in Exhibit 1. Examples of tasks to be performed under the contract include:

 

                     Perform day-to-day field inspections to monitor APP’s activities and performance.

                     Prepare daily inspection reports documenting construction activities.

                     Monitor work for compliance with contract requirements including applicable codes, permits, specifications, and drawings; where non-compliance is noted, bring it to APP’s attention and document corrective action taken.

                     Attend progress meetings (weekly or as deemed necessary) between APP, the City, and other interested parties. Review meeting minutes and provide comments where applicable.

                     Create photo and video documentation of field conditions during pre-construction, construction, and post-construction phases.

                     Review contract progress payments including measurements of bid items and progress schedule.

                     Monitor project budget, purchases, and payments, as well as review work progress against the baseline schedule.

                     Enforce Labor Compliance requirements through spot checking of certified payroll and keeping accurate records of APP’s daily field staff. 

                     Evaluate, negotiate, recommend, and prepare responses to change orders presented to the City by APP. 

                     Perform independent quantity and cost analysis of proposed changes presented to the City by APP. Analyze additional compensation claims submitted by APP and prepare responses. Should APP have claims against the City, provide claims administration, including coordinating and monitoring claims responses, logging claims, and tracking claims status.

                     Provide quality assurance for APP’s environmental mitigation monitoring.

                     Monitor APP’s Storm Water Pollution Prevention Plan compliance and required correction of discrepancies.

                     Ensure that APP enforces safety and health requirements and applicable regulations for the protection of the public and project personnel. Document compliance.

                     Monitor and document construction contract closeout services, including preparation of punch lists and finalization of bid items, claims, and change orders.

                     Audit completed project against design plans and provide acceptance of the project.

 

It is recommended that the City Council approve this professional services contract with Ghirardelli in the amount of $452,904 for the work described above.

 

FINANCIAL IMPACT

 

There are sufficient appropriations available in the Seaplane Lagoon Ferry Terminal project (91814) to cover the cost of the contract proposed for approval. 

 

POLICY DOCUMENT CROSS REFERENCE

 

This action will implement the adopted Master Infrastructure Plan for Alameda Point.

                      

ENVIRONMENTAL REVIEW

 

On April 5, 2016, the City Council certified the Seaplane Lagoon California Environmental Quality Act (CEQA) Addendum to the Alameda Point Final EIR in compliance with CEQA. The Addendum evaluated the environmental impacts of constructing and operating a ferry terminal at Seaplane Lagoon. No further review is required for this review of the project designs. 

 

RECOMMENDATION

 

Authorize the City Manager to execute a 24-month agreement with Ghirardelli Associates for construction management services for the Seaplane Lagoon Ferry Terminal project at Alameda Point, in an amount not to exceed $452,904.
