EXECUTIVE SUMMARY

 

On June 6, 2023, City Council authorized an agreement with Verde Design, Inc. (Verde) to provide engineering services for Phase 2 of the Estuary Park Project (Agreement). On April 15, 2025, City Council authorized a first amendment to the Agreement to provide engineering services during bidding and construction, which was not included in the original scope.

 

Staff recommends City Council authorize the Interim City Manager to execute a second amendment to the Agreement to address additional engineering services that were inadvertently omitted from the first amendment, as well as to provide design revisions required to address an unforeseen underground utility conflict identified during construction.

 

The proposed second amendment authorizes an amount not to exceed $21,400.  The total Agreement with the second amendment will be not-to-exceed $427,145.

 

BACKGROUND

 

Estuary Park was designed to be the primary neighborhood park for Admiral’s Cove, Alameda Landing, and other nearby neighborhoods. It also serves residents at Alameda Point, including those living at the Alameda Point Collaborative and the future RESHAP affordable housing development. Phase 1, which was designed by Verde, opened to the public in January 2019 and included two synthetic turf athletic fields.

 

Phase 2 of the Estuary Park Project expands the park to include amenities, such as restrooms, picnic areas, benches, drinking fountains, open lawn area, an inclusive playground, pickleball courts, basketball court, dog parks, Bankshot inclusive basketball system, and a parking lot with chargers for electric vehicles.

 

On June 6, 2023, City Council authorized an Agreement with Verde Design, Inc. to provide engineering services for Phase 2 of the Estuary Park Project for a total not-to-exceed $295,825.  

 

City Council approved the conceptual design for Phase 2 in June 2024.

 

On April 15, 2025, City Council approved a first amendment to the Agreement to extend the term, increase design fees to address plan check comments and provide engineering services during project bidding and construction for an amount not-to-exceed $109,920 for a total agreement cost of $405,745. The Agreement and first amendment are included as Exhibit 2.

 

Construction of phase 2 started in November of 2025.

 

DISCUSSION

 

Staff recommends City Council authorize the Interim City Manager to execute a second amendment to the Agreement to address additional engineering services that were inadvertently omitted from the first amendment, as well as to provide design revisions required to address an unforeseen underground utility conflict identified during construction.

 

The proposed second amendment authorizes an amount not to exceed $21,400 (Exhibit 1).  The total Agreement with the second amendment will be not-to-exceed $427,145.

 

ALTERNATIVES

 

                     Authorize the second amendment to the Agreement in an amount not-to-exceed $21,400 for additional engineering services for the Estuary Park Phase 2 Project.

                     Adopt the second amendment with directed revisions.

                     Do not authorize the second amendment. This will result in the City’s contractor not having revised plans to address the utility conflict, which could lead to portions of the project not being completely built.

 

FINANCIAL IMPACT

 

Funding for the second amendment is available in the Capital Improvement Program, Project No. C52500, for Estuary Park Phase 2. There is no additional impact to the General Fund.

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action is consistent with the Alameda Municipal Code. This supports the City of Alameda Strategic Plan project CS12 to complete design and construct Phase 2 of Estuary Park under the priority to Enhance Community Safety and Services. This action is subject to the Levine Act.

 

ENVIRONMENTAL REVIEW

 

Similar to the Phase 1 constructed project, the Phase 2 project consists of the rehabilitation and improvement of a previously existing park. Both Phases are consistent with the zoning and general plan designation for the property, and the improvements will be subject to the existing design requirements of the Alameda Municipal Code ensuring compatibility with adjacent land uses. For these reasons, the project, including the additional work authorized by this contract amendment, will not result in any significant environmental impacts and will be categorically exempt from further environmental review under the California Environmental Quality Act (CEQA) pursuant to Sections 15301 (existing facilities), 15302 (replacement or reconstruction), and 15303 (new construction or conversion of small structures).

 

Separately, as part of the LWCF grant funding Phase 2 of the project, the National Park Service (NPS) directed the City of Alameda (City) to complete cultural and biological studies to substantiate the City’s compliance with certain LWCF criteria. The California Dept. of Parks and Recreation, which manages LWCF funds on behalf of NPS, confirmed compliance with NPS criteria.

 

CLIMATE IMPACT

 

There are no identifiable climate impacts or climate action opportunities associated with the subject of this report. 

 

RECOMMENDATION

 

Authorize the Interim City Manager to execute a second amendment to an Agreement with Verde Design, Inc., in an amount not-to-exceed $21,400, for additional engineering services related to the Estuary Park Phase 2 Project, for a total contract amount not-to-exceed $427,145.
