EXECUTIVE SUMMARY

 

The first 4-acre phase of Estuary Park opened to the public in January 2019. In June 2024, City Council approved the conceptual design plan for Phase 2 of Estuary Park. This second phase is tentatively scheduled to be published for bid in February 2025. To reduce the project’s duration and cost, staff recommend purchasing a prefabricated restroom in advance of the construction contract award. This approach has the potential to advance the schedule by up to two (2) months and provide a savings of $105,000. Staff recommends City Council authorize the City Manager to execute an agreement with Public Restroom Company for the purchase and installation of a prefabricated restroom at Estuary Park in an amount not-to-exceed $541,371. Pricing is based on Public Restroom’s Sourcewell Contract #081721-PRM.  The City of Alameda (City) is an active member of Sourcewell, a national purchasing agency, whose cooperative purchasing agreements have been competitively solicited in conformance with state and local purchasing requirements.

 

BACKGROUND

 

The first 4-acre phase of Estuary Park, which includes two synthetic turf athletic fields, opened to the public in January 2019. In June 2024, City Council approved the conceptual design for Phase 2 of Estuary Park, which includes neighborhood park amenities such as restrooms, picnic areas, benches, drinking fountains, open lawn area, an inclusive playground, pickleball courts, basketball court, dog parks, Bankshot inclusive basketball system and a parking lot with chargers for electric vehicles. Funding for Phase 2 was secured through a $2.5 million grant from the federal Land and Water Conservation Fund (LWCF) administered by the California Department of Parks and Recreation with matching funds available in the Estuary Park Phase 2 Capital Improvement Program project budget.

 

Estuary Park Phase 2 construction will include a restroom facility to serve the new park, as well as the athletic fields completed in 2019.  The restroom will be centrally located between existing athletic fields and new park features. The restroom will be accessible, meeting or exceeding current ADA standards, and include six (6) single occupancy unisex rooms.

 

Staff anticipate going out to bid for the construction of Estuary Park Phase 2 in February 2025 with City Council consideration of the contract in April.

 

In an effort to reduce project costs and better control the construction schedule, staff recommend separating the restroom fabrication from the overall construction project. This is a common approach that has been used on other park projects. The City purchasing the restroom in advance is estimated to save $105,000 in contractor mark-up and given the long lead times for the restroom, reduce the project timeline by 2 months. 

 

DISCUSSION

 

The City is an active member of Sourcewell, a national purchasing agency, whose cooperative purchasing agreements have been competitively solicited so that government agencies can utilize their agreements meeting all state, local and federal public procurement requirements, including prevailing wage rates.  The City uses cooperative purchasing as a purchase method that complies with public procurement requirements for goods and services.

 

Pricing in the proposed agreement is based on Public Restroom Company’s Sourcewell Contract #081721-PRM. The scope of work includes building the restroom offsite, delivering it, and connecting it to the existing utilities once built. Public Restroom Company has provided restrooms at Jean Sweeney Open Space Park, Bohol Circle Immigrant Park, Encinal Boat Ramp, and other park sites and is a well-known company for prefabricated buildings that are well-built and easy to maintain.

 

ALTERNATIVES

 

                     Award the contract as recommended.

                     Do not award the contract and direct staff to include the restroom as part of the overall Estuary Park Phase 2 construction drawings. Due to current lead times for procuring the restroom product and construction overhead, this alternative is estimated to add two months to the construction schedule and approximately $105,000 in additional cost.  

 

FINANCIAL IMPACT

 

Funds to purchase the restroom are available in Capital Improvement Project C52500 - Estuary Park Phase 2. Funding for Phase 2 was secured through a $2.5 million grant from the federal Land and Water Conservation Fund (LWCF) administered by the California Department of Parks and Recreation with matching funds previously appropriated from the Development Impact Fee and General Fund.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Alameda Municipal Code.

 

Project CS12 in the City’s Strategic plan is to, “Complete design and construct phase 2 of Estuary Park.”

 

This action is subject to the Levine Act.

 

ENVIRONMENTAL REVIEW

 

In accordance with the CEQA, this action is categorically exempt from further environmental review pursuant to CEQA Guidelines Sections 15301 (Existing Facilities), 15302 (Replacement or Reconstruction), and 15303 (New Construction of Small Structures).

 

CLIMATE IMPACTS

 

The Estuary Park Phase 2 modular restroom building is an all-electric building without natural gas service connections. Natural gas use from buildings is one of the larger emission sources of greenhouse gas emissions (GHG). The City’s Climate Action and Resiliency plan recommends the electrification of buildings to reduce GHG emissions.

 

RECOMMENDATION

 

Authorize the City Manager to execute an agreement with Public Restroom Company for purchase and installation of a prefabricated restroom at Estuary Park in an amount not-to-exceed $541,371.
