EXECUTIVE SUMMARY
On July 16, 2019, City Council approved with conditions, Tentative Map No. 8500 per City of Alameda Resolution No 15570 which identified Lot 4 for condominiums. On November 17, 2020, City Council approved the Final Map for Tract 8500 per City of Alameda Resolution No 15772. Tract Map 8500 subdivided the Alameda Marina Site into five developable lots. Tract 8711 is a one-lot subdivision of Lot 4 of Tract Map 8500 for condominium purposes. Public Improvements associated with Tract Map 8711 includes the construction of a portion of the Bay Trail consistent with the Alameda Marina Master Plan. Staff recommend City Council adopt the proposed resolution approving the final map and authorizing execution of a Subdivision Improvement Agreement for Tract 8711, The Foundry.
BACKGROUND
In July 2018, City Council certified the Alameda Marina Final Environmental Impact Report (Final EIR) and approved the Alameda Marina Master Plan which established standards, maps and diagrams for the development of a mixed use plan for the property that provided for up to 760 multifamily housing units, up to 250,000 square feet of commercial and maritime commercial space, approximately 3.6 acres of shoreline open space, 17.1 acres dedicated to marina operations, and a 530 slip marina.
On June 24, 2019, the Planning Board reviewed Tentative Map No. 8500 and clarifying amendments to the Master Plan and unanimously recommended that City Council approve the tentative map. On July 16, 2019, City Council approved Tentative Map No. 8500 and all supporting documents and exhibits, determining that the Tentative Map is consistent with the General Plan, Alameda Municipal Code (AMC), and Master Plan requirements for the property. The Final Map for Tract 8500 was approved by City Council on November 19, 2020, pursuant to Resolution 15722.
On September 19, 2023, City Council adopted Ordinance 3351 amending the Alameda Marina Master Plan and approving a density bonus to increase the Alameda Marina sitewide housing unit count from 760 to 801 units across the entire Alameda Marina site. The Master Plan Amendment allowed an increase of 22 units in the Phase 3 Alameda Marina Wrap B, The Foundry residential building.
DISCUSSION
The Alameda Marina Master Plan, Master Plan Amendment, Tentative Map, and Design Review Approval were approved to construct up to 801 residential units and up to 250,000 square feet of commercial space on the 44-acre site located at 1815 Clement Avenue and commonly known as Alameda Marina. The development includes 27 acres of uplands and submerged lands and approximately 17 acres of waterfront and submerged lands (tidelands) owned by the City of Alameda (City) in trust for the State of California. Tract Map 8500 subdivided the privately owned 27 acres and created five developable lots and four additional parcels for parking, open space, and maritime purposes. Tract 8711 is a one lot subdivision for condominium purposes of Lot 4 of Tract 8500 located at 1999 Clement Avenue.
The Alameda Marina Master Plan allows up to 259 residential condominium units and 1 work-live unit for a total of 260 units on Lot 4.
This subdivision will dedicate utility easements within Lot 4. The subdivision will also create a parcel for open space and maritime purposes. Public improvements associated with Tract 8711 include the construction of portions of the Bay Trail. These improvements are consistent with the Master Plan and Tentative Map.
The improvement plans include work on Lot 4 and the adjacent Lot 3. Total infrastructure improvements include sanitary sewer and storm drain lines, sidewalk, curb and gutter, private roadway, private parking lot and landscaping. Improvements as part of this subdivision improvement will be privately maintained by the respective property owners. Public access and public utility easements will be granted to the public at part of Tract 8711 or have previously been granted per Tract 8500.
Approval of a final subdivision map is an administrative and ministerial action by the City Council once the City Engineer has determined that the final map is in substantial compliance with the Subdivision Map Act, previously approved tentative subdivision map conditions of approval, and is technically correct. The Planning, Building, and Transportation Department and the Public Works Department completed their reviews of the improvement plans and final map for Tract 8711, The Foundry. The final map has been reviewed and determined to be technically correct and in substantial conformance with the approved tentative map, conditions of approval, and mitigation measures. Staff has determined that the developer has satisfied all conditions of approval necessary to record the final map.
Alameda Marina LLC has entered into a Subdivision Improvement Agreement (Exhibit 2) for the construction and completion of the public and private improvements within Tract 8711 and has provided a performance bond guaranteeing the full and faithful performance of the public improvements in the amount of $4,629,000 and a labor and materials bond in the amount of $4,629,000. Section 30-86.9 of the AMC requires completion of subdivision improvements within 24 months of the execution of the SIA. Alameda Marina, LLC has requested, and the City Engineer supports, a 3 year (36 month) term for completion of the improvements. The City Attorney has reviewed and approved as to form the Subdivision Improvement Agreement and bonds as the form of security.
ALTERNATIVES
Approval of the final map is ministerial in nature. City Council may:
• Approve the final map for Tract 8711, as recommended.
• Remand the project back to staff for further consideration and evaluation on any specific Tentative Map condition of approval.
FINANCIAL IMPACT
All of the improvements are private and will be constructed by the subdivider and maintained by the property owner. There is no impact to the General Fund.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
As described above, the recommended final map for Tract 8711, The Foundry is consistent with the General Plan, the Zoning Ordinance, and the Alameda Marina Master Plan. This action is subject to the Levine Act.
ENVIRONMENTAL REVIEW
Approval of the Final Map and the Subdivision Improvement Agreement is exempt from CEQA pursuant to Public Resources Code section 21080(b)(1) (ministerial projects) and CEQA Guidelines section 15268 (ministerial projects). As a separate and independent basis, a Final EIR was certified by City Council on July 10, 2018, for the Alameda Marina Project in accordance with CEQA, and no further review is required pursuant to Public Resources Code section 21166 and CEQA Guidelines section 15162.
CLIMATE IMPACT
The project will contribute to the City’s Climate Action and Resiliency Plan goals to reduce the City’s greenhouse gas emissions, increase quality of life on the island, and adapt to climate change impacts. The overall development plan for the Alameda Marina supports alternative transportation by providing participating in a Transportation Demand Management program, providing a dock location for water shuttle service across the estuary, and a number of bicycle path improvements including constructing a portion of the Cross Alameda Trail.
RECOMMENDATION
Adopt a resolution approving the final map and authorizing execution of the Subdivision Improvement Agreement for Tract 8711, The Foundry, located at the Alameda Marina site.
