EXECUTIVE SUMMARY
Klinton Kehoe, doing business as Patrol Solutions, LLC (Patrol Solutions) provides security services at Alameda Point under an existing Service Provider Agreement (Agreement) which expires on May 14, 2025.
Staff recommends the Second Amendment to extend the existing Agreement for an additional 77-days, with an increase in compensation reflecting CPI adjustments as required in the original Agreement. This extension will provide time for staff to conduct a Request for Proposals (RFP) public process for security services at Alameda Point.
As recommended, the additional contract amount for the new term would be $70,392, and the four-year total not-to-exceed amount would be $1,019,965.
BACKGROUND
Patrol Solutions provides security services for City of Alameda-owned vacant buildings at Alameda Point. On May 15, 2022, RiverRock Real Estate Group as property manager for the City of Alameda (City), entered into a service provider agreement with Patrol Solutions and on May 2, 2023, the City ratified that agreement (Exhibit 1).
In August 2023, the City entered into a First Amendment to the agreement with Patrol Solutions that extended the term through May 14, 2025, and adjusted the compensation by the Consumer Price Index (CPI) for the San Francisco Bay area as reported by the U.S. Department of Labor, Bureau of Labor Statistics for the previous calendar year (Exhibit 2).
DISCUSSION
The Second Amendment would extend the existing Agreement for an additional 77 days in an amount not-to-exceed $70,932 for a four-year total not-to-exceed amount of $1,019,965.
Before the expiration of the proposed Second Amendment, staff intends to issue an RFP for security services at Alameda Point. In the interim, this Second Amendment will maintain continuity of service until such time that the RFP process is complete.
ALTERNATIVES
• Authorize the City Manager to execute the Second Amendment to the Agreement with Patrol Solutions for an additional 77-day term.
• Direct staff to negotiate different terms and authorize the City Manager to execute an agreement that includes such terms, if acceptable to Patrol Solutions.
• Do not authorize a second amendment to the Agreement for security services at Alameda Point. This will cause a disruption in service.
FINANCIAL IMPACT
The proposed Second Amendment would be paid out of Base Reuse funds. This proposal would have no impact on the General Fund.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action is consistent with the Alameda Municipal Code, and the City’s Strategic Plan Priorities to attract and retain Alameda Point businesses. This action is subject to the Levine Act.
ENVIRONMENTAL REVIEW
This action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 and therefore no further CEQA analysis is required.
CLIMATE IMPACT
There are no identifiable climate impacts or climate action opportunities associated with the subject of this report.
RECOMMENDATION
Authorize the City Manager to execute the Second Amendment to the Service Provider Agreement with Klinton Kehoe dba Patrol Solutions, LLC, for an additional 77-day term, not-to-exceed $70,392, and a total four-year expenditure not-to-exceed S1,019,965, for Security Services at Alameda Point.
