EXECUTIVE SUMMARY

 

Awarding a contract to Ninyo & Moore, geotechnical and environmental sciences consultants, for $128,230 will provide the Cross Alameda Trail along Ralph Appezzato Memorial Parkway (CAT/RAMP) Improvement Project with continuous off-site air/dust monitoring only for the first eight to twelve weeks of construction during the earth moving work that has the potential to generate dust. This will ensure that engineering controls and construction practices put in place by the general contractor will prevent off-site emissions of any air borne contaminates from the construction zone, during and after work hours.

 

This work has been required by the Alameda County Department of Environmental Health (ACDEH) prior to mobilizing for construction.  Ninyo & Moore will develop a work plan (for ACDEH review/approval) and then place four air-monitoring instruments, one upwind and three downwind, along the phased project perimeter. One portable weather station will also be installed to monitor wind direction, speed, temperature, and humidity (all equipment will be enclosed, secure and lockable).  Data from these instruments will be wirelessly transferred to a reporting website, which will also include email and text alerts, when necessary, to inform all parties (consultant, City, contractor, ACDEH).  While not expected, if airborne dust emissions exceed certain levels, the City, consultant, and contractor will conduct a risk evaluation and take immediate corrective measures.

 

BACKGROUND

 

Once completed, the full Cross Alameda Trail will be a premier east-west walking and bicycling corridor, with many sections completely separated from cars, stretching from the Seaplane Lagoon at Alameda Point to the Miller-Sweeney Bridge at Tilden Way for a total of four miles. The Jean Sweeney Open Space Park (Sweeney Park) segment from Constitution Way to Sherman Street, the first major trail segment, was completed and opened to the public in December 2018.

 

The development of the CAT/RAMP and Atlantic Avenue segment from Main Street to Constitution Way began in 2014. In 2015, the Transportation Commission (TC) and Planning Board approved the preliminary design for the Main Street to Webster Street segment, but the project was put on hold pending further soil analysis and the development of a soil remediation plan to meet the requirements of ACDEH. Meanwhile, in late 2015, City staff began working on a design concept for the Webster Street to Constitution Way segment, a critical one-block connector between the CAT/RAMP and Sweeney Park trail segments. The TC and City Council approved a final concept plan for this one-block segment in March and April 2017, respectively.

 

The CAT/RAMP segment and the one-block Atlantic Avenue connector will be constructed as one project, between Main Street and Constitution Way, which totals approximately 0.9 miles. The design features of the concept plans, as approved by the TC and City Council for the two segments, include:

 

                     Ralph Appezzato Memorial Parkway  (Main Street to Webster Street) - Construct separate walking and bicycling paths, plus a decomposed granite jogging path, in the City-owned abandoned railroad right-of-way with the following additional features:

o                     Connector trails to two intersecting streets: Fifth Street and West Campus Drive;

o                     Pedestrian, bicycle, and Americans with Disability Act (ADA) improvements;

o                     New plazas at Main Street and Webster Street with hardscape and landscape features;

o                     Landscaping with trees and shrubs; and

o                     Traffic signal modifications at Fifth Street.

                     Atlantic Avenue (Webster Street to Constitution Way) - Construct separated two-way bicycle lanes on the south side of this short urban block. Make improvements at the intersections at both ends of the segment to increase safety for people walking and bicycling. Install a mid-block pedestrian crossing.

 

DISCUSSION

 

Approval and award of this contract is time-sensitive.  ACDEH’s requirement for this work was not communicated to project staff (or to prospective bidders) until March 2019.  The project was awarded to McGuire & Hester, a Notice to Proceed was delivered on February 11, 2019, and earth moving activities are planned for April. No earth moving activities can take place without ACDEH approving the work plan and the perimeter off-site air/dust monitoring being mobilized and fully in place.  Hence the need for expediency in requesting and receiving approval for this consultant contract. Failure to award this contract will delay the project and risk incurring construction delay costs.

After reviewing the bids and contacting several references provided by the consultant, staff recommends awarding the contract to Ninyo & Moore for the bid amount plus contingency for a total amount not to exceed $128,230.  The work is based on time and materials and therefore the total expended will be lower if the earth moving work takes less than twelve weeks. The consultant is not guaranteed any of the contingency and its use will be at the sole discretion of the Public Works Director for work not originally anticipated in the specification.  A copy of the contract is attached as Exhibit 1.

 

FINANCIAL IMPACT

 

Budget for the contract is included in the Public Works Department Capital Improvement Projects Fund (Project No. 91402). This project is funded with monies allocated from the General Fund, Construction Improvement Tax, Measure B/BB, and various grants.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Municipal Code.

 

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt pursuant to CEQA Guidelines section 15301(c) - Existing Facilities and 15304(b) - Minor Alterations to Land and 15304(h).  In accordance with the National Environmental Policy Act, this project is a Categorical Exclusion under 23 Code of Federal Regulations 771.117(c): activity (c)(3) - Construction of bicycle and pedestrian lanes, paths and facilities.

 

RECOMMENDATION

 

Authorize the Interim City Manager to award a one-year contract in the amount not to exceed $128,230, including contingency, to Ninyo & Moore for the CAT/RAMP Improvements, No. P.W. 03-18-11.
