AMENDING THE ALAMEDA MUNICIPAL CODE BY ADDING SECTION 8-8.10 (NO PARKING IN BICYCLE LANES) TO ARTICLE 8-8 (GENERAL PARKING REGULATIONS) OF CHAPTER VIII (TRAFFIC, MOTOR VEHICLES AND ALTERNATIVE TRANSPORTATION MODES), TO PROHIBIT THE PARKING OF A VEHICLE IN ANY DESIGNATED CLASS II, CLASS III, OR CLASS IV BICYCLE LANE WITHIN THE CITY OF ALAMEDA

WHEREAS, the City of Alameda has an extensive network of bicycle lanes and bikeways throughout the City to promote safe and efficient travel for people riding bicycles; and

WHEREAS, California Vehicle Code Section 21211 prohibits parking in a Class I bikeway (multi-use path), but does not clearly extend that prohibition to Class II (bike lanes), Class III (bike routes and bike boulevards), or Class IV (separated bike lanes) bikeways; and

WHEREAS, the absence of clear state law prohibition on parking in Class II, III, and IV bikeways requires the City to rely on alternative citation bases - such as parking prohibited all times, no double parking, or out-of-marked-space violations - to address vehicles parked in bicycle lanes, workarounds that are not uniformly applicable across the City's bicycle network; ...
