Recommendation to Authorize the City Manager to Execute a Third Amendment to the Agreement with ELS Architects, Inc. in an Amount Not-to-Exceed $171,470, for City Aquatic Center Preliminary / Conceptual Design Services, including Design Development, through December 31, 2028, for a Total Compensation Amount Not-to-Exceed $3,446,306.50.
In July 2014, City Council by Resolution No. 14955 adopted the Jean Sweeney Open Space Park MND and Mitigation Measures in compliance with California Environmental Quality Act (CEQA). In accordance with Section 15164 of the CEQA Guidelines, an Addendum to the MND has been prepared in the manner required by and as authorized under CEQA. The Addendum and conditions of approval for the planning entitlements incorporate and will require compliance with all applicable mitigation measures from the 2014 MND. Accordingly, the Aquatic Center project does not raise important new issues about potentially significant impacts on the environment that have not been previously disclosed in the MND, and no further environmental review is required.

EXECUTIVE SUMMARY
The City Aquatic Center (Center), located on the west side of Sweeney Park, will provide critical additional pool space to meet the increasing and unmet community needs for competitive and recreational aquatic programs. This Third Amendment with ELS Architects, Inc. (ELS), included as Exhibit 1, in an amount not-to-exceed $171,470, provides scope for ELS to complete the construction documents and specifications for bidding the Center. The total compensation for design services under the Agreement, as amended, shall not exceed $3,446,306.50. This is an anticipated expense that is already included in the project budget contingency.
