EXECUTIVE SUMMARY
Alameda Municipal Code Section 30-95.1 requires the Planning Board to conduct a public hearing at which the applicant must demonstrate good faith compliance with the terms and conditions of any Development Agreement. MidPen Housing, and on behalf of their collaborating partners (Alameda Point Collaborative, Building Futures With Women and Children, and Operation Dignity), has submitted a letter demonstrating their good faith compliance with the terms and conditions of their Development Agreement, as amended. (Exhibit 1)
Staff is recommending that the Planning Board approve the annual report and find that the developers have complied in good faith with the terms and conditions of the Development Agreement. The Development Agreement can be found on the City of Alameda website at:

BACKGROUND
In June 2018, the City of Alameda and MidPen Housing etal entered into a Development Agreement (DA) for the project. In December 2023, the City and MidPen Housing entered into an amended DA to increase the number of units from 267 to 309, all of which will be deed restricted as affordable to serve extremely low-income, very low, and low-income residents by providing housing and supportive services that will help to break the cycle of homelessness and establish stability and opportunity in the lives of residents and create a cohesive, pedestrian-friendly, and inviting community.
