EXECUTIVE SUMMARY

The City of Alameda is currently engaged in ongoing litigation against Greenway Golf Associates, Inc., Alameda Superior Court case number 22CV011964. This case was set for jury trial in September of 2024. In September 2024, the trial court continued the trial date to April of 2025. Due to this extension and in anticipation of ongoing litigation and jury trial costs, the City Attorney's Office is recommending that the Golf Fund litigation budget for the current fiscal year be increased in the amount of $800,000 and be funded from Residual General Fund fund balance.

FINANCIAL IMPACT

As part of the Fiscal Year 2024-25 City of Alameda Mid-Cycle Operating Budget, City Council authorized a $200,000 transfer from the General Fund (Fund 100) to the Golf Fund (Fund 250) for a total Golf Fund expenditure budget across all expenditure accounts of $853,450. There is a need for an appropriation of $800,000 from Residual General Fund fund balance to the Golf Fund to fund these anticipated ongoing litigation costs.

This action is consistent with the Alameda Municipal Code.
