Approve the 2024 Annual Report or Provide Direction, including Possible Formation of a Subcommittee

BACKGROUND

On March 5, 2024, the City Council adopted an ordinance amending Sunshine Ordinance requirements related to annual reports. Under Alameda Municipal Code (AMC) Section 2-22.4, the Commission has a duty to: "From time to time as the Commission sees fit, issue public reports evaluating compliance with the Sunshine Ordinance by the City or any Department, Office, or Official thereof." AMC Section 2-93.6 now states: "The Commission shall prepare an annual report to be placed on the City's website and made generally publicly available in printed form of alleged violations of the Ordinance heard by the Hearing Officer during the previous calendar year. The report shall identify the nature of the alleged violation, the relief sought by each petition, the disposition or current status thereof, the location of all records relevant to each petition, and any practical or policy problems encountered in the administration of the Sunshine Ordinance."

In 2023, the Commission requested staff's assistance with drafting the annual report. In prior years, the Commission appointed a subcommittee to draft a report on problems encountered in administration of the Sunshine Ordinance.

DISCUSSION

This item was placed on the agenda to allow the Commission to either approve the report drafted by staff with any amendments or provide direction and have the report return to the Commission at its next meeting. The Commission may discuss and add any issues related to evaluating compliance with the Sunshine Ordinance or problems encountered in the administration of the Sunshine Ordinance. Alternatively, the Commission could form a subcommittee to finalize the report and have the matter return at the next meeting.
