AMENDING THE ALAMEDA MUNICIPAL CODE BY AMENDING ARTICLE 3-61 (TRANSIENT OCCUPANCY TAX) OF CHAPTER 3 (FINANCE AND TAXATION) TO IMPLEMENT SENATE BILL 346 AUTHORIZING CITIES TO REQUIRE SHORT TERM RENTAL PLATFORMS TO PROVIDE ADDITIONAL INFORMATION TO CITIES
WHEREAS, effective January 1, 2026, the Legislature adopted SB 346. This State legislation authorizes cities and counties to adopt an ordinance that requires a short-term rental facilitator to transmit information that allows cities and counties to effectively enforce the payment of transient occupancy taxes by guests in these accommodations.
WHEREAS, as determined by the Ninth Circuit Court of Appeals in HomeAway.com, Inc. v. City of Santa Monica (9th Cir. 2019) 918 F.3d 676, requiring the transmittal of this information violates neither the federal Communications Decency Act nor the First Amendment.
WHEREAS, the City Council desires to opt-in to SB 346.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ALAMEDA DOES HEREBY ORDAIN AS FOLLOWS:
