BACKROUND
 
On March 20, 2012, the City Council awarded a contract to Water Works Engineers Inc. for engineering design services for the relocation of two existing sewer mains (lagoon seawall and Clinton Avenue extension).  The regional sewer facilities are being relocated from under existing homes and removed from the lagoon wall and new sewer connections are being made in the street right-of-way along Hawthorne and St. Charles Streets as part of the regional sewer relocation.  The sewer relocation requires a new 15-foot wide public sewer easement to be dedicated and accepted through two private parcels located at the end of Hawthorne Street.  Final design plans are estimated to be completed in July 2014.
 
DISCUSSION
 
The new 15-foot wide sewer easement will be used to install a new 8" public sewer main and connect two existing manholes along a 101-foot section of Hawthorne Street that has no public sewer main installed.  The new sewer easement is located directly between and adjacent to 1200 and 1231 Hawthorne Street and runs between two existing single-family homes within their side yard driveway and landscaped area.  The two homes are located at the southern end of Hawthorne Street adjacent to the South shore lagoon. The Public Works Department plans require the installation of an 8" sewer main within the easement by use of Horizontal Directional Drilling (HDD) to minimize surface disturbances. The existing surface improvements are proposed to be restored and replaced in-kind once the project construction is complete.
A certified appraiser was hired by Public Works to perform a valuation and formally appraise the monetary value of the permanent sewer and temporary construction easements on the two parcels.  The current values of the proposed easement acquisitions were based on the square footage of the required easements, the proposed duration of the use of the temporary construction easements, and a comparison market data approach.
Easement 1 - 1200 Hawthorne Street - 11-foot wide easement valued at $3,288.00 owned by Keating Family Property, LLC.
Easement 2 - 1231 Hawthorne Street - a 4-foot wide easement valued at $1,160.00 owned by Mary Jane Davis.
City of Alameda Resolution No. 5328 authorizes the Mayor or Vice Mayor to consent to the acceptance of Deeds and Grants of real property or Easement thereon, for the purpose of dedication.  In accordance with City requirements, RJA Land surveyors have prepared the easement plats and legal descriptions for the proposed permanent and temporary construction easements.  Public Works Department staff have reviewed the sewer easement legal descriptions and determined them to be acceptable for dedication.  
FINANCIAL IMPACT
 
The funds for this project are budgeted in the Capital Improvement Program (Fund 310 Project Number 90909), for the abandonment and relocation of existing sanitary sewer main along lagoon seawall and sewer line along Clinton Avenue, with monies from the Sewer Enterprise Fund (Fund 602).
.  The cost associated with acquiring the two new permanent sewer easements is based on two professional real estate appraisals obtained to provide a base value for both the permanent sewer easements and temporary construction easements.  The property owners felt the "appraised value" purchase price was not suitable.  Public Works negotiated and settled for a slightly higher value for the easement purchase.  An alternative to these settlements would be to condemn a portion of the property for the easements, which is a lengthy and expensive legal process. Public Works has settled the negotiations for a reasonable and fair value as follows:
Payment 1 - 1200 Hawthorne Street - $5,000 to Keating Family Property, LLC in exchange for a temporary construction easement, the permanent sewer easement, and other loss of use.
Payment 2 - 1231 Hawthorne Street - $1,554.40 to Mary Jane Davis in exchange for a temporary construction easement, the permanent sewer easement, and  other loss of use.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
 
This action does not affect the Alameda Municipal Code.
ENVIRONMENTAL REVIEW
 
In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under CEQA Guidelines Section 15305, Minor Alteration in Land Use Limitations.
RECOMMENDATION
 
Adopt a resolution ordering acceptance of two Grants of Easements to the City of Alameda from private residents for a proposed sewer main easement located at the end of Hawthorne Street, 1200 Hawthorne Street, and 1234 Hawthorne Street in exchange for valuable consideration and request recordation of Grant of Easement.
