BACKGROUND
The Alameda-Contra Costa Transit District (AC Transit) has completed a comprehensive evaluation of the improvements needed along Line 51 (see Exhibit 1). In order for the improvements to occur, the City and AC Transit must enter into an Agreement. The following discussion contains the provisions of that Agreement to improve Line 51's design and performance.
DISCUSSION
The key points of the Cooperative Agreement are:
* City of Alameda (City) as a stakeholder affirmatively supports the improvements proposed by the project;
* The City will conduct the review of AC Transit's design documents, and if consistent with standard City details, incorporate them into encroachment permits for the project. The City will provide construction inspection oversight to assure compliance with City standards and quality control of all material within the City's rights-of-way;
* The City will issue an encroachment permit to AC Transit and its Contractor to perform the work within City's rights-of-way. Permits will include City fees for all work mentioned above;
* AC Transit will reimburse the City for staff assistance and oversight through the encroachment permit process. Contractor will pay encroachment permit fees;
* The City will maintain all bus stops installed as part of this project except where maintenance is provided by another maintenance provider;
* AC Transit will indemnify and save harmless the City, and its officers and employees from all claims, suits...
