BACKGROUND
 
The City of Alameda (City) is the owner of Pier 3 at Alameda Point.  On April 2006, the City approved a 20-year sublease with the Maritime Administration (MARAD).  As part of the technical requirements in support of the lease, the City is obligated to provide reliable sewage system to the ships.  On December 2012, the City's Port Manager, NRC Environmental Services (NRC) notified the Public Works Department of a sewer line break at the east end of Pier 3.  Upon closer inspection, it was determined that the break was the result of failing pipe hangars under the Pier that hold the sewer line in place.  Approximately 85' of pipe was affected and hangars throughout that section will need to be replaced.  
 
An emergency repair was sought, but due to the excessive initial repair cost projections, the existing system was shut down instead and a temporary diversion was made.  NRC brought out large tanks which were placed on the pier.  MARAD ships and the USS Hornet began pumping their sewage into these tanks, which have been regularly maintained by NRC.  Since that time, the objective has been to find a reasonable long term solution.
 
DISCUSSION
 
MARAD has requested that the sewage system be brought back online immediately to bring the City back in line with its Lease obligations.  Power Engineering Construction Co. (Power) has provided a comprehensive proposal to make the repair in a timely and long lasting fashion.  The proposed project will include the replacement of the corroded underdeck sewer pipe hangars, replacement of the missing main line and the installation of underdeck hanging scaffolding for use during future repairs.  Onsite work is estimated to be completed in eight weeks.  Staff recommends awarding a contract to Power Engineering Construction Co. (Power) for $222,155, which includes a 10% contingency of $20,196.  Power is not guaranteed any of the contingency amount and use of the contingency will be at the City's sole discretion for work not originally anticipated in the plans and specification.  Power was also informed that they shall pay not less than the prevailing rate of per diem wages as determined by the State and Federal Government.  A copy of the contract is attached as Exhibit 1.
 
This contract was sole sourced based on a State of California Public Contracting code specifically for public sewer line maintenance and repair and exempts it from public bid.  This is to create flexibility and immediate response for emergency sewer work and to prevent significant amounts of discharge into open water.
 
FINANCIAL IMPACT
 
The funds for this project are budgeted in the Base Reuse Department account (Fund 819099).  There is no impact to the General Fund.

This action does not affect the Alameda Municipal Code.
 
ENVIRONMENTAL REVIEW
 
In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under the CEQA Guidelines Section 15301(c) - Existing Facilities.
 
RECOMMENDATION
 
Award contract in the amount of $222,155, including contingencies, to Power Engineering Construction Co. for Alameda Point Pier 3, sewer replacement project.
