BACKGROUND

 

On March 3, 2015, in accordance with the Landscape and Lighting Act of 1972, the City Council appointed an engineer and an attorney for the annual proceedings associated with Maintenance Assessment District (MAD) 01-01 in Marina Cove, and authorized the preparation of the Engineer's Report.  On May 19, 2015, the City Council preliminarily approved the Engineer's Report, declared an intention to order levy and collection of Marina Cove assessments, and set a public hearing for July 7, 2015.

 

DISCUSSION

 

MAD funds the maintenance of Marina Cove's street trees, medians, sidewalks, pathways, irrigation, lighting, and the associated utility costs.  The Engineer's Report was prepared in accordance with Section 22565 et seq. of the California Streets and Highways Code.  The report includes an estimated annual budget to maintain the public improvements within MAD.  This year, there is no allocation from fund reserves to cover expenses above the current year's budget.  In coming years, with additional assessment funds from Marina Cove Phase II, there is the potential for additional reserve collection or reduced assessments.

 

An automatic Consumer Price Index (CPI) increase was authorized in the founding of this MAD. Accordingly, the assessments will increase by 2.53%, which is the CPI for the Bay Area for the month ending February 2015.  A vote of the property owners is not required.

 

Public Works staff proposes that the City Council adopt a resolution to approve the Engineer's Report, confirm the diagram and assessment, and order the levy of assessments in Marina Cove's MAD.  A copy of the Engineer's Report is attached.

 

FINANCIAL IMPACT

 

MAD was created to maintain public improvements associated with the Marina Cove development.  Funds that are not expended in a fiscal year remain within the assessment district (Fund 276) and may be used for future expenses.  The cost to administer the MAD, including full City cost allocation, is approximately $16,500 and is included within the proposed budget.  There is no impact to the General Fund.

This action does not affect the Municipal Code.

 

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under the CEQA Guidelines Section 15301, Maintenance of Existing Facilities.

 

RECOMMENDATION

 

Public Hearing to consider adoption a resolution approving the Engineer's Report, confirming diagram and assessment, and ordering levy of assessments, Maintenance Assessment District 01-01 (Marina Cove).
