Re: Adoption of Resolution Approving the Final Map, Authorizing Execution of the Subdivision Improvement Agreement and Approval of Performance and Labor and Materials Bonds, and Accepting the Dedications and Easements for Tract 8285 (Alameda Landing Residential, Phase 3)

 

BACKGROUND

 

On June 18, 2013, the City Council approved Tentative Map Tract 8131 and Tract 8132 per City of Alameda Resolution No 14834.  Tentative Map Tract 8131 specified that the tract will be developed in two phases.  On March 4, 2014, the City Council approved the Final Map for the first phase of Tract 8131 (Alameda Landing Residential, Phase 1) for 77 lots per City of Alameda Resolution No. 14900.

 

On November 18, 2014, the City Council approved the Final Map of Tract 8132 (Alameda Landing Residential, Phase 2) for nine lots designated as condominiums per City of Alameda Resolution No. 14977.

 

Alameda Landing Residential, Phase 3, consists of the second phase of Tract 8131 (now known as Tract 8285).  This Final Map for Tract 8285 provides for 29 lots.  Lots 90-94 are for condominium purposes.  Lots 78-89, 96-107 are residential single family homes.  The Final Map also includes public utility and emergency vehicle access easements.  The Final Map is attached and also on file in the Public Works Department.

 

DISCUSSION

 

The Final Map has been reviewed and determined to be technically correct and in substantial conformance with the approved tentative map, conditions of approval, and mitigation measures.  The tract infrastructure includes sanitary sewer and storm drain lines, sidewalk, curb, gutter, street pavement, and landscaping.  The Homeowners Association will maintain the private infrastructure and the City will maintain the public improvements.

 

The Alameda Municipal Code requires the subdivider to enter into a Subdivision Improvement Agreement (SIA) with the City and post-performance bonds guaranteeing the public improvements.  On November 19, 2013, the City Council consented to the transfer of residential rights and responsibilities in the Alameda Landing Mixed Use Development to TriPointe Homes.  At this time, TriPointe Homes does not own the land.  Once the Final Map is approved and recorded, TriPointe Homes will acquire the property.  Once TriPointe acquires the property, the City will execute the SIA and obtain the performance bond guaranteeing the public improvement improvements in the amount of $235,050 and the labor and materials bond in the amount of $235,050.  The Public Works Department has reviewed and recommended for approval and the City Attorney has reviewed and approved as to form the SIA.  The bonds will need to be reviewed and approved by the City Attorney prior to the SIA being executed.

 

FINANCIAL IMPACT

 

There is no impact to the General Fund since all the tract improvements will be constructed by the subdivider and maintained by the homeowner's association.

This action does not affect the Municipal Code.

 

ENVIRONMENTAL REVIEW

 

On December 5, 2006, the City Council certified the Final Environmental Impact Report (EIR) for the Alameda Landing Mixed Use Development Project (a Supplement to the 2000 Catellus Mixed Use Development Project (EIR) in accordance with the California Environmental Quality Act (CEQA) (State Clearinghouse #2006012091).  The City approved three Addenda to the 2006 SEIR in 2007, 2008, and 2012 that found the Tentative Maps will not result in any new or substantially more severe environmental impacts than identified in the SEIR.    In addition, the approval of a final map is exempt from CEQA pursuant to CEQA Guidelines section 15263(b)(3).

 

RECOMMENDATION

 

Adopt a resolution approving the final map, authorizing execution of the SIA and performance and labor and materials bonds, and accepting the dedications and easements for Tract 8285 (Alameda Landing Residential, Phase 3).
