BACKGROUND

 

In accordance with requirements of the Final Consent Decree arising out of the litigation concerning the Environmental Protection Agency’s (EPA’s) lawsuit against the East Bay Municipal Utility District (EBMUD), the City of Alameda, and other jurisdictions, the Public Works Department is upgrading the City’s existing sanitary sewer pump stations to limit public health impacts associated with sanitary sewer overflows and to improve reliability and safety.  On February 15, 2011, the City Council awarded Schaaf & Wheeler a contract for engineering design services for the City of Alameda Sewer Pump Station Upgrades.  On October 6, 2015, the City Council awarded a construction contract to Mountain Cascade for the Group 2 - Sewer Pump Station Renovations for Reliability and Safety Improvements Project (“Renovations Project”).

 

There are six pump stations to be renovated as part of the renovations project.  The Verdemar Pump Station, located in the common area within Tract 2936, requires a new 108 square-foot easement to expand the existing 180 square-foot easement already located on that property.  The existing and proposed easements are on a 9.157 acre common area site owned by Casitas Alameda Homeowners Association.

 

DISCUSSION

 

The new 108 square-foot sewer pump station easement will house a new motor control center and Supervisory Control and Data Acquisition (SCADA) pole so that real time operational data can be monitored from a central system.

 

Public Works staff hired a certified appraiser, Landmark Valuation, real estate appraiser and consultant, to perform a valuation and formally appraise the monetary value of the proposed permanent sewer easement.  The current value of the proposed easement was based on the square footage of the required easement and the current as is fair market value has been determined to be $1,000.

 

City of Alameda Resolution No. 5328 authorizes the Mayor or Vice Mayor to consent to the acceptance of Deeds and Grants of real property or easement thereon, for the purpose of dedication.  In accordance with City requirements, RJA Land surveyors have prepared the easement plats and legal descriptions for the proposed permanent easement.  Public Works Department staff have reviewed the sewer easement legal descriptions and determined them to be acceptable for dedication.  The certified appraisal, the easement legal descriptions and plats of the subject easements are attached.

 

FINANCIAL IMPACT:

 

The funds for this project are budgeted in the Capital Improvement Program (Project Number 91604), for Sewer Pump Station Rehabilitation, with monies from the Sewer Enterprise Fund (Fund 602).

 

The City will be acquiring a permanent easement for a sewer pump station on private property.  The cost associated for the easement is based on a professional real estate appraisal of $1,000, and the property owner, the Casitas Alameda Homeowners Association, has agreed that the $1,000 is a fair price for the permanent easement.

This action does not affect the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under CEQA Guidelines Section 15305, Minor Alteration in Land Use Limitations.

 

RECOMMENDATION

 

Adopt a resolution accepting a grant of easement to the City of Alameda from the Casitas Alameda Homeowners Association for a sewer pump station easement located within the common area in Tract 2936 (Verdemar Drive and Flora Vista Drive) in exchange for valuable consideration and direct the recording of the grant of easement.
