BACKGROUND

 

On April 29, 2015, the City Council adopted a resolution approving a six-year Memorandum of Understanding (MOU) between the Alameda Fire Chiefs Association (AFCA) and the City of Alameda.  While the MOU approved by the City Council addressed significant Other Post-Employment Benefits (OPEB), also known as lifetime medical benefits, the agenda report that was given to the City Council acknowledged that the MOUs on file with the City Clerk, might be subject to administrative correction for clerical purposes.  These recommended revisions were initiated by the City to better clarify and/or update the language of the current benefits received.  There is no financial impact from the proposed revisions.

 

DISCUSSION

 

Staff has reviewed the respective safety MOUs and is recommending administrative corrections to the MOU between the AFCA and the City to reflect current medical contribution rates, dental plan modifications, and to update language changes related to the Public Employment Pension Reform Act (PEPRA).  The language under Funeral Leave is being changed to reflect current and historic practice.  The OPEB language was corrected to reflect that certain contributions would derive from the employee, not the City.

 

Finally, in late 2014, CalPERS audited the City and it was suggested that specific uniform rates be listed within the text of the MOU, as well as clarifying the full title of the Public Service Credit for Federal or State Firefighter Service.  Additionally, it was pointed out that CalPERS has updated its list of what is reportable compensation and non-reportable compensation.  The Management Incentive provision is being modified to incorporate the Office Assignment Incentive to better clarify the Office Assignment’s compensability under CalPERS, which is the current practice.

 

FINANCIAL IMPACT

 

There is no financial impact from the proposed revisions.

This action is consistent with the Alameda Municipal Code.

ENVIRONMENTAL REVIEW

 

This action is exempt from the California Environmental Quality Act (CEQA) because it is not a project which has a potential for resulting in either a direct physical change in the environment, pursuant to CEQA Guideline section 15378.

 

RECOMMENDATION

 

Adopt a resolution approving the administrative corrections to better reflect current medical contribution rates, dental plan modifications, to update language changes related to the Public Employment Pension Reform Act (PEPRA), and to list specific uniform rates to the Memorandum of Understanding (MOU) between the Alameda Fire Chiefs Association (AFCA) and the City of Alameda for the period of November 1, 2015 through December 18, 2021.
