Title: Adoption of the Annual Public Report

Summary

The Sunshine Ordinance provides that the Open Government Commission prepare an Annual Public Report to be placed on the City's website of alleged violations of the Ordinance brought to the attention of the Commission during the previous calendar year and the disposition thereof. In 2015 there was one such violation and the Commission determined it was unfounded. A draft Annual Public Report is attached. If approved by the Commission, it will be posted on the City's website.

Background

The Sunshine Ordinance provides the Open Government Commission shall prepare an Annual Public Report to be placed on the City's website and made generally available in printed form of alleged violations of the Sunshine Ordinance brought to the attention of the Commission in the previous calendar year. Section 2-93.6. The Report is to identify the nature of the alleged violation, the relief sought, the disposition thereof and the location of all records relevant to the violation.

Discussion

During 2015, there was one alleged violation of the Ordinance that was brought to the attention of the Commission. That complaint alleged that the City Council had violated Section 2-92.2 (d) by failing to respond to a request for public records within three business days as to how, when and by whom the information would be provided and violated Section 2-92.15 that public record requests made by email must be acknowledged with an email reply to the sender.

The Commission considered this complaint at its meeting on October 14, 2015. It determined that the complaint was unfounded. The records relative to this complaint are on file with the City Clerk.
