BACKGROUND

 

On October 27, 2014, Catellus Alameda Retail, LLC granted a public utility easement to the City of Alameda for installation and maintenance of utilities for the benefit of Alameda Municipal Power (AMP).  The easement was recorded and filed in the Office of County of Alameda Recorder on November 4, 2014.  After construction of the commercial building, it was revealed that the building was built over a portion of the easement.  This portion of the easement does not have electrical infrastructure and AMP has confirmed it to be excess easement.  To eliminate portions of the easement under the commercial building, a portion of the easement will be quitclaimed.

 

DISCUSSION

 

The Quitclaim Deed is attached as Exhibit 1.  The Public Works Department and City Attorney’s Office staff have reviewed and are in agreement with the document.

 

FINANCIAL IMPACT

 

There is no financial impact to the City as a result of this action.  The property owner paid all costs associated with the requested termination.  There is no impact to the General Fund.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Municipal Code.

 

ENVIRONMENTAL REVIEW

 

The proposed project is categorically exempt from further review under the California Environmental Quality Act pursuant to CEQA Guidelines Section 15301: Maintenance, Repair, and Improvement of Existing Facilities.

 

RECOMMENDATION

 

Adopt a resolution terminating a portion of an existing public utility easement within Parcel Map 10086, 2650 Fifth Street, and recordation of Quitclaim Deed.
