Re: Adoption of a Resolution Granting a Utility Easement to Pacific Gas & Electric Company within Neptune Park
BACKGROUND
On September 17, 2008, the City granted Pacific Gas & Electric Company (PG&E) a utility easement in City-owned parcel, Neptune Park, to accommodate a utility line relocation project. As part of the improvements for the City's Willie Stargell Avenue Extension Project in 2009, it was important that PG&E utilities be relocated out of Webster Street right-of-way and into Neptune Park. PG&E required an easement in Neptune Park prior to the relocation, which the City granted.
PG&E recently brought to the City's attention that the September 2008 recorded easement granted an easement for only a portion of the relocated utility line. The remaining utility line is currently not in an easement. PG&E seeks a grant of easement for the remaining utility line.
DISCUSSION
The Easement Deed is attached as Exhibit 1. The Public Works Department and City Attorney's Office staff have reviewed and are in agreement with the document.
FINANCIAL IMPACT
There is no financial impact to the City as a result of this action. All costs associated with the operation, maintenance and repair of the facilities in a safe, sanitary and fully operational conditions will be borne by PG&E or their successors. There is no impact to the General Fund.
MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE
This action does not affect the Municipal Code.
ENVIRONMENTAL REVIEW
The proposed project is categorically exempt from further review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301: Maintenance, Repair, and Improvement of Existing Facilities.
