Title: City Attorney Semi-Annual Reports to the City Council
Background
At its February 1, 2016 meeting, Commissioner Dieter inquired about certain reports that the City Attorney is required to prepare under the Sunshine Ordinance. Under Section 2-91.8 a, the City Attorney semi-annually is to make a determination whether any closed session minutes should continue to be exempt from disclosure, based on whether disclosure would be detrimental to the City, and shall provide a report to the City Council. Section 2-91.12 e provides the City Attorney shall prepare and present on the City Council Consent Calendar a list of documents that have been determined to be public after previously determined to be unavailable to the public; this list shall be presented at least semi-annually and available on the City’s website.
The Assistant City Attorney responded he did not know the status of such reports but that he would make inquiry with the City Attorney.
Discussion
The City Attorney has confirmed that the reports contemplated by Sections 2-91.8a and 2-91.12e are routinely provided to the City Council and the most recent of which, copy attached, was on the Council’s May 17, 2016 agenda. The next such report will be on the Council’s agenda in November 2016.
