BACKGROUND

 

Jean Sweeney Open Space Park (Sweeney Park) is a 27-acre park bounded by Constitution Way, Atlantic Avenue, and Sherman Street. The site is the former Alameda Beltline Railroad property that was secured by the City at its original purchase price due the advocacy efforts of long-time resident Jean Sweeney.  The Cross Alameda Trail is a bicycle trail that ultimately will run the length of the island from east to west.  The trail through Sweeney Park is a protected bicycle trail and will connect with the future trail along Ralph Appezzato Memorial Parkway.  It also includes a protected bicycle connection along Atlantic Avenue that will connect the two trail segments between Constitution Way and Webster Street.

On July 5, 2016, City Council approved a service provider agreement with Macks Craic Inc. (Mack5) for construction management services for park development projects. 

The approved agreement includes a provision requiring a Notice to Proceed to implement the next phase in the scope of work.  The next phase is construction of the Cross Alameda Trail through Jean Sweeney Open Space Park.  This project is funded from the Active Transportation Program with matching funds from the Open Space Fund and Measure B.

DISCUSSION

 

This action is to approve the Notice to Proceed to Mack5 as required by the approved agreement and appropriate the funds for the next phase of mack5’s construction management services for the Cross Alameda Trail through Jean Sweeney Open Space Park. 

The City has no liability for, nor is Mack5 entitled to, compensation for additional services until another Notice to Proceed is issued and authorized by the City Council.  These additional services will not be brought to City Council until additional funding is available. There are four reasons the staff recommendation is to use Fund Balance from the General Fund for this contract: 1) there are larger than anticipated General Fund cost savings from FY15/16 due to vacancies and lower expenses citywide; 2) at this time other restricted funds generally utilized for park improvement projects are insufficient, including Development Impact Fees (DIF); 3) future DIF funds will be needed for future phases of this project and other park projects; and 4) the grant funding source does not include these types of construction soft costs and this project must continue to move forward to remain within the required timelines for use of this significant Active Transportation Program grant funding.

 

FINANCIAL IMPACT

 

The Cross Alameda Trail - Jean Sweeney Open Space Park project design and construction is funded by the Active Transportation Program grant in the amount of $2,231,000 plus required city matching funds from Measure B and the Open Space Funds for a total amount of $2,520,000.  These funds are allocated in the Capital Improvement Program budget, Project 91614.

Additional appropriation of $160,000 is required for the Cross Alameda Trail - Jean Sweeney Open Space Park Project 91614 to cover the costs of the construction management contract presented for approval tonight as well as other construction administration costs.  Staff recommends to allocate the money from the General Fund available fund balance to cover these costs. The Fiscal Year 2016-17 Budget will be amended as follows:

ENVIRONMENTAL REVIEW

 

For this project, on July 15, 2014, the Council adopted a Mitigated Negative Declaration (MND) that identified minimal environmental impacts, and those that were identified are related to the construction period (e.g. dust, construction traffic, etc.).  The MND provides mitigations to minimize those impacts.  The design development plan for this project is consistent with the adopted MND and there will be no new environmental impacts that were not previously evaluated.

Recommendation to authorize the City Manager to issue a Notice to Proceed with Macks Craic Inc. (dba mack5) for construction management services for the Cross Alameda Trail through Jean Sweeney Open Space Park and appropriate $160,000 to the Cross Alameda Trail project 91614 budget from the General Fund available fund balance.
