BACKGROUND

 

The Mastick Senior Center painting project consists of repainting the exterior surfaces of the Mastick Senior Center, 1155 Santa Clara Avenue. Laboratory testing of the existing exterior painted stucco, conducted by Oaks Environmental Testing Company, shows the presence of Lead-Based Paints (LBP) throughout the exterior of the center. The project specifications requires the contractors to be trained and Environmental Protection Agency-certified on how to handle LBP surfaces.

 

DISCUSSION

 

To comply with California Uniform Construction Cost Accounting Act (CUPCCAA) requirements in soliciting the maximum number of bids and the most competitive price, a Notice Inviting Bids and project specifications was advertised in 12 separate builders exchanges throughout the Bay Area. The notice inviting bids was also published in the Alameda Journal and put on the City’s website. Five contractors submitted bids. Bids were publicly opened and read aloud on Monday, September 12, 2016. The list of bidders from lowest to highest for total project cost is as follows:

The first apparent low bidder, Color New Company, withdrew their bid due to error in not including their profit in their bid proposal. On Point Construction submitted a bid proposal in the amount of $144,000; however, staff found that On Point Construction did not add up their prices correctly. Their correct bid proposal is $151,000. In addition, On Point Construction neglected to include a required bid item price in their bid proposal. Therefore, On Point was found non-responsive. The next apparent low bidder, So Unique Painting & Decorating, asked the City to accept his request to withdraw his bid due to difficulty in obtaining the required bonds for LBP pollution coverage.

 

The last two bidder proposal amounts exceeded the project budget allocation of ($165,000). Staff recommends that City Council reject all bids and authorize a call for rebid to obtain bids that are competitive and within budget.

 

FINANCIAL IMPACT

 

The funds for this project are budgeted in the Public Works Department’s account for Capital Improvement Program (Project No. 91609) for Mastick Senior Center painting project with monies from the Capital Improvement Projects Fund (Fund 310). There is no impact to the General Fund.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Municipal Code.

 

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under CEQA Guidelines Section 15301(b), Existing Facilities.

 

RECOMMENDATION

 

Reject all bids and authorize a call for rebid for the Mastick Senior Center painting project, No. P.W. 08-16-16.
