Re: Adoption of Resolutions Accepting Grants of Easements to the City of Alameda from First 5 Alameda County and the Seastrand Owners Association for Sewer Pump Station  and Related Public Utility Purposes and Direct the Recording of the Grants of Easements

 

BACKGROUND

 

In accordance with requirements of the Final Consent Decree arising out of the litigation concerning the Environmental Protection Agency’s (EPA’s) lawsuit against the East Bay Municipal Utility District (EBMUD), the City of Alameda, and other jurisdictions, the Public Works Department is systematically upgrading the City’s existing sanitary sewer pump stations to limit public health impacts associated with sanitary sewer overflows and to improve reliability and safety.  On February 7, 2017, the City Council awarded a construction contract to McGuire and Hester for the group 3 - sewer pump station renovations for reliability and safety improvements.

 

Two of the pump stations undergoing renovation require additional easement area. The Triumph/Independence Pump Station, located at 1302 Triumph Drive, requires a new 230 square-foot easement to expand the existing 575 square-foot easement already located on that property.  The existing and proposed easements are on a 1.614 acre site owned by First 5 Alameda County.  The Seaview I Pump Station, located at 2901 Seaview Parkway, requires a new 371 square-foot easement to expand the existing 255 square-foot easement already located on that property.  The existing and proposed easements are on a 0.085 acre common area site owned by the Seastrand Owners Association.

 

DISCUSSION

 

The new 230 square-foot sewer pump station easement at the Triumph/Independence pump station site is for the new alignment of the stations’ pressurized pipe and bypass pumping connection point.  The new 255 square-foot sewer pump station easement at the Seaview I pump station is for underground electrical conduit from the stations wet well to the new control panel, which was strategically placed to minimize visual impacts.

 

Public Works staff hired a certified appraiser, Landmark Valuation, real estate appraiser and consultant, to perform valuations and formally appraise the monetary value of the proposed permanent sewer easements.  The current value of the proposed easements was based on the square footage of the required easements and the current, as is, fair market value were determined to be $3,000 for the easement on the First 5 Alameda County property and $1,000 for the easement on the Seastrand Owners Association property.

 

City of Alameda Resolution No. 5328 authorizes the Mayor or Vice Mayor to consent to the acceptance of Deeds and Grants of real property or easement, for the purpose of dedication.  In accordance with City requirements, RJA Land Surveyors and Kier and Wright prepared the easement plats and legal descriptions for the proposed permanent easements.  Public Works Department staff reviewed the sewer easement legal descriptions and determined them to be acceptable for dedication.  The grant of easement, legal descriptions, and plats; certified appraisals; and certificate of acceptance for each of the subject easements are attached as Exhibits 1, 2, 3, 4, 5, and 6.

 

FINANCIAL IMPACT:

 

The funds for this project are budgeted in the Capital Improvement Program (Project Number 91008), for Sewer Pump Station Rehabilitation, with monies from the Sewer Enterprise Fund (Fund 602).

 

The Public Works Department is acquiring two permanent easements for sewer pump stations on private property. The cost associated with the First 5 Alameda County easement is based on a professional real estate appraisal of $3,000, and the First 5 Alameda County has agreed that the $3,000 is a fair price for the permanent easement.  The cost associated with the Seastrand Owner’s Association easement is based on a professional real estate appraisal of $1,000, and the Seastrand Owner’s Association has agreed that the $1,000 is a fair price for the permanent easement.

 

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

In accordance with the California Environmental Quality Act (CEQA), this project is Categorically Exempt under CEQA Guidelines Section 15305, Minor Alteration in Land Use Limitations.

 

RECOMMENDATION

 

Adopt two resolutions accepting grants of easements to the City of Alameda from the First 5 Alameda County and the Seastrand Owners Association for sewer pump station and Public Utility purposes and direct the recording of the grant of easements.
