BACKGROUND

 

Estuary Park is eight acres of former Navy/Coast Guard property, on Mosely Avenue near Singleton Avenue.  Construction of the first phase of the project started in August 2016 and construction is anticipated to be completed in July 2017. 

 

On April 29, 2016, the City issued a Request for Proposal and received three proposals for geotechnical testing and inspection services.  Ninyo and Moore’s proposal was the most qualified and responsive.  On July 14, 2016 City Council approved an agreement with Ninyo and Moore for geotechnical testing and inspection services. 

 

During a construction project, the City is required to have a Geotechnical Engineer of Record for testing and inspecting the soils throughout construction. Services include performing laboratory tests to evaluate subgrade, fill or aggregate base for the synthetic turf athletic fields or to evaluate compressive strength of concrete or high-strength grout, as well as to assume the official role of Geotechnical Engineer of Record for the project.

 

DISCUSSION

 

This amendment is for additional services due to the extended construction schedule from mid-May 2017 to (potentially) late-August or September 2017, due to the significant and unusual wet winter weather experienced and to the unanticipated presence of contaminated soils in certain site areas previously expected to be “clean”.  This extended the construction schedule by a minimum of three months, which has a financial impact on all consultants related to the project construction, including the testing and inspections performed by Ninyo and Moore.

 

These additional services are for the Storm Water Pollution Prevention Program (SWPPP) management that is required during construction to ensure that the contractor is using - and continues to use - SWPPP best management practices.

 

FINANCIAL IMPACT

 

Budget for the contract is included in the Recreation and Parks Department Capital Improvement Project Fund (Project No. 91311).  The project is funded with monies allocated from grants, private donations, General Fund, Dwelling Unit Tax, and Development Impact Fees. The City Council previously approved the original contract and the contract amendments as presented below:

MUNICIPAL CODE/POLICY DOCUMENT CROSS REFERENCE

 

This action does not affect the Alameda Municipal Code.

 

ENVIRONMENTAL REVIEW

 

The proposed project includes the rehabilitation and improvement of an existing park, the project is consistent with the zoning and general plan designation for the property, and the improvements will be subject to the existing design requirements of the Alameda Municipal Code ensuring compatibility with adjacent land uses. For these reasons, the proposed project will not result in any significant environmental impacts and is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15301 (existing facilities), 15302 (replacement or reconstruction), and 15303 (new construction or conversion of small structures).

 

RECOMMENDATION

 

Authorize the City Manager to execute an amendment to an agreement with Ninyo and Moore to add the amount of $22,275 for a total agreement amount of $122,604 and to extend the term six months to September 30, 2017 for geotechnical testing and inspection services for Estuary Park.
